Vacating a property before the agreed date by the tenant

I have rented my villa to an Emirati person. The contract was from Nov 2019 to Nov 2020, but she vacated the villa on Feb 2020.

As per the contract "If the tenant wishes to terminate the contract prior to the expiration, the tenant must give two months written notice to the landlord and the landlord will charge the tenant 2 months rent from the date of vacating the property as a penalty".

I had a Cheque dated 28/02/2020 and a cheque of security deposit. I presented both but they are bounced.

What is the next step?

Dear Questioner,

You can file criminal and civil cases against the person for the due rent + notice period + 2 months rent.

You can file a civil case against the same person after checking if she is still inside the country and if she has other cases to be sure that you will collect your dues before paying court and lawyer fees.

We can help you to check her existence in UAE, but for the criminal case, you can file it anyway as it is free.

(even for the criminal case, ask a lawyer first as there are important points to consider)
