Q: Hi. I am employed by a DMCC company with a limited contract. I have finished 1 year 3 months to the company and decided to leave. As this is a small company wherein operated by just me and my boss, he doesn't want to release me till we found a replacement. I am serving my 30 days notice period till 21 of this month and on process of finding a replacement (interviews ongoing).
My question is if he wasn't able to find a replacement till 21 of this month, does he have the right to force me to extend my service? He keeps on threatening me that he will file a case and make a problem for me in mediation and labour.
Please help. I am willing to pay the 45 days early termination fine. I just want to leave the company. :(

Can the employer reduce the notice period date?

Q: Hi Hari,
Appreciate if you can help me on the below query.
I have recently resigned from my employer during the probation period. I submitted my resignation 12 days prior to my last working day and mentioned my last working day in my resignation.
However, as per the employment contract, I have to serve them a notice period of seven days during the probation.
My employer has now changed my last working day (for eg: If my last working date was 22nd of Oct they changed it to 17th of October) mentioning that you only have to serve a seven-day notice.
Could you please advise if they are allowed to change my last working date?
As per my understanding, it was a minimum of seven-day notice. However, I could have provided the resignation before that mentioning my last date.
If they want to change the last working they have to terminate me on a minimum notice of seven days.
Also, please let me know if during my probation I will be eligible for annual leave encashment and repatriation allowance.

Forceful extension of the employee notice period upon resignation

Q: Hi Madam,
Good afternoon.
I am writing on behalf of my wife. She is working as a school nurse in Dubai for more than 3 years.
Now, my wife got a good offer and submitted resignation on 26th August 2018 by mentioning last day of working as of 07th October 2018.
The school accepted the resignation and asked for 45 days salary as compensation. We also agreed to give the compensation and informed the new school that she will join on 08th October 2018.
But now they are asking to work for some more days as KHDA inspection is coming to school by the end of October.
We told them it is not possible because we already informed the new school about the join date. The current school still have not started any relieving process.
How can we overcome this issue?

I just took over a company as a manager in the DED (Dubai Economic Department).
It is an LLC company. however, the previous manager is not completing the handover to me.
I have not been given any financial reports or any other related documents. so what should I do to cover myself?

Threatening to hold the final settlement due to refusal of extending the notice period

Q: Dear questioner,
I have submitted my resignation letter with a 1-month notice period. Now that my last day is approaching, my manager is threatening to hold my final settlement and forcing me to extend my notice period.
Despite informing my HR and manager of my health issues, they are continuing with their actions.
Please advise!

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
