الاستقالة أثناء فترة الاختبار وتكاليف التأشيرة
مرحبًا،
أعمل في شركة ذات مسؤولية محدودة. لقد مر ثلاثة أشهر فقط وما زلت في فترة الاختبار.
لقد استقلت لكنهم يطلبون مني دفع تكاليف التأشيرة من التسوية النهائية. هل يُعد هذا الأمر قانونيًا؟
إذا لم يكن كذلك، كيف يمكنني تقديم شكوى وأين؟
يبدو أن تأشيرتي تابعة لمنطقة حرة.

Dear Questioner,
Visa fees are the responsibility of the employer and it is against the law to ask for compensation of the visa fees even if you resign during the probation period.
You can place a complaint at the Free Zone Authority where you work and they will guide you through.
Please find below the related law:
Article 6 (a) of the Ministerial Order (52) of 1989 which stipulates:
The employer or its legal representative shall sign the recruitment application form prepared by the Ministry for this purpose, such form shall include the following undertakings:
"An undertaking from the employer to the effect that he shall sponsor and be responsible for the recruited Labourer, the bearing of his recruitment expenses and his employment in accordance with the employment contract in a way not prejudicing the provision of the Federal Law No (8)/1980 referred to herein."
