Q: We formed a company in Umm Al Quwain Free Zone in 2018 and the license expired in August. One of the investors in on the company visa (his visa is valid).
We want advice on the following:
1. We want to close the current company.
2. Are all the partners/shareholders required to personally visit to complete the closure formalities?
3. Since its formation, the company has not conducted any activities. What will be its liabilities?
4. What's the process for cancellation?

Q: I am a partner in an LLC registered in Dubai, whose license was expired in Nov 2017.
I was a passive investor stationed in India and the company was managed my senior partner and MD (Managing director) of the company who was stationed in Dubai.
The company was not managed well, the licenses were not renewed and the business activities did not take place. My last visit was in May 2017.
The MD of the company is still in Dubai on an earlier visa but didn't get in touch with me and he's not reachable.
Now, I want to start a new venture in any free zone on an individual basis. How can I cancel the earlier visa and get a new investor visa in the free zone?
Is it necessary to liquidate the old company in order to cancel the visa? Is it possible for me to cancel the visa on an individual basis and apply for new company formation?
Please guide me.

Filing a case against an employer because of payout reduction

Q: The company I work for was sold at a loss. The employer is saying that the employees need to accept a reduction in their payouts to share the burden.
The employer is not based in the UAE. If I go to court and win, what can I do to ensure that the employer will pay if he is not based in the UAE and he says that he does not have money to pay?

Transferring the employees to a new company without paying the gratuity

Q: Hi,
My company in DMCC is planning to shut down. They are not willing to pay us the gratuity.
They have offered the remaining staff, including me, to be transferred to a new company they are opening soon.
Is there any way we can get a continuation of the contract in order not to lose our gratuity in the long run?
We have all been in the company for more than 8 years now.

Will I receive my unpaid salaries and gratuity after the company closes?

Q: Hello Ma'am/Sir,
I have been working for more than four years at a company based here in Abu Dhabi. My company is supposedly closing down due to financial debt, and I have received my termination letter.
Will I be able to get all the salaries that the company hasn't given to me, and will I still be able to receive my gratuity?

فسخ عقد عقاري وطلب التعويض نتيجة عدم الوفاء بالالتزامات 0
سلام عليكم،
أنا اشتريت ٣ وحدات عقارية من شركة كبيرة بدبي وكان العقد بتاريخ ١١/٢٠١٥ وتاريخ التسليم ١١/٢٠١٧ ولم يتم اكتمال المشروع إلا في ٥/٢٠١٩ وحدثت خسائر مادية بسبب تغيير أسعار العقارات بالإمارات والأقساط المدفوعة للشركة مقابل الوحدات مما تسبب في خسائر مالية.
سعر الوحدة بتاريخ ٢٠١٥ كان ١٥٥٠٠٠٠ درهم وحاليًا بسعر ٩٠٠٠٠٠ درهم مع العلم أن المساحة الكلية للعقار أقل من المساحة بالعقد بمقدار ١٥ متر بعد الكشف على مساحة الوحدات من قبل خبير عقاري.
هل يمكن إعادة مبلغ الوحدات وفسخ العقد؟ وكم نسبة التعويض في هذه الحالة؟

استرداد المبلغ المدفوع لمطور بعد مراوغته وإلغاء العقار 0
مرحبًا،
اشتريت عقار من مطور ودفعت نسبة 24% من المبلغ في سنة 2015، إضافة إلى حجز عقارين من المطور نفسه. تم إلغاء حجز العقارين وتحويل أموال الحجز إلى العقار الذي دفعت فيه نسبة 24%.
تم التعاقد معي على أن يتم تسليم العقار في سنة 2017، وبعدها قاموا بالتمديد لمدة سنة حسب العقد، على أن يتم تسليمه في سنة 2018. تواصلت معي شركة المطوِّر لإخباري أن العقار الذي اشتريته في الوحدة المذكورة في المشروع المحدد تم إلغاؤه.
قمت بمراجعة دائرة الأراضي والأملاك ولم يفيدوني بشيء. راجعت شركة المطور ولم يتم إثبات ذلك.
راودتني الشكوك ولم أكمل معهم الدفعات المتبقية. فوجئت بإلغاء العقار عن طريق دائرة الأراضي والأملاك رغم تقديمي شكوى عن الموضوع الذي طرحته من قبل بشأن إلغاء الوحدة في المشروع.
لم أتمكن من استرجاع أموالي بأي طريقة حيث قام المطور بالانتهاء من العقار بنفس الوقت الذي تم فيه إلغاء العقار من اسمي وتم بيعه لطرف آخر حسب ما ذُكِر لي.
يُقدَّر المبلغ المدفوع بمبلغ 700,000 درهم.
