صلاحية اتفاقية التسوية واسترداد الأموال المستحقة

لم يتم سداد سندات بقيمة 125 ألف جنيه إسترليني مستحقة لي من مكتب عائلي في إمارة دبي في التاريخ المحدد 31 يوليو 2019.

بعد إعطاء العديد من الوعود الكاذبة بسداد أموالي، وقعت في النهاية اتفاقية تسوية تنص على السداد على مدى 10 أشهر تبدأ في شهر يناير 2020.

لم يتم سداد الدفعة الأولى في تاريخ الاستحقاق وألقى مكتب العائلة باللوم على النظام المصرفي. وصلت الدفعة المستحقة في النهاية اليوم، بعد حوالي 10 أيام من تاريخ الاستحقاق.

أشعر بالقلق من أن اتفاقية التسوية قد تم انتهاكها بالفعل، وأنني قد أواجه مشاكل في المدفوعات المستقبلية.

أعتقد أنه نظرًا لخرق اتفاقية التسوية، قد أتمكن من استرداد المبلغ المستحق بالكامل وقدره 120 ألف جنيه إسترليني.

Would a Court award me my full costs of taking out the action?

I would not want to spend money on a court action if I could not be certain that the other party could pay any award made, but I do not seem to be able to get financial information for the LLC anywhere.

Is there any way of finding out the financial position of LLC and their directors?

As you mentioned that you have signed an agreement for payment terms, if he violates the terms of the agreement, you may file a civil case in court against the person and get an order in your favour.

To file a civil case, you need to appoint a lawyer and pay the court fee (that you can get back and the court will ask the other person to pay).

This procedure may take time, therefore always better settle things amicably.
