Q: A commission agreement between broker and seller was drafted and signed by the two parties in Dubai. The agreement states that the seller shall pay the broker a certain amount of commission after the sale transaction is done.
How can the broker guarantee his right 100% in case the seller doesn’t pay?
Shall the broker register the agreement with the notary public or the Ministry of Economy?
Please take note that the location is Dubai.

Q: I need assistance on the agent/broker commission.
I had bought a property recently wherein I approached directly the sales office of the developer and booked one apartment.
The developer has appointed an agent/broker from their side to handle the process. As per the SPA, the broker is eligible for an amount of 2% from the seller side.
Now, after completion of the handover, the same broker is asking for 2% from my end.
The property is bought directly from the developer and I am the primary owner (i.e. the property is not a resale property).
Is the broker eligible to 2% commission on the property value again from the buyer when he has already been paid by the developer?
The SPA does not mention any commission from the buyer, can the broker still insist on the commission?
As a buyer, what rights do I have in this scenario?

A client refuses to pay the brokerages fees

Q: I am a real estate agent. Recently, one of my clients viewed a floor on my behalf. He came through my advertisement and I arranged his viewing.
After viewing, he took a complete floor directly from management. He denied paying my brokerage fees. I am an agent who makes viewing on the 7th floor in the building and the building security knows very well that no one came before for this floor.
After 4 days, my client closed the deal directly because there is a number mentioned in the management at the building security reception. When I called the management to inform him, he is a key client, one of them replayed: "sorry, we can’t do anything for skipping the agency fees".
I need legal advice on how to take legal action.
Please help!

Q: Hello,
We are a European (Slovakia) registered LLC company legally structured to do real estate brokerage. We are about to sign a contract with a major Dubai developer as a service provider to help them sell their units.
We agreed on a commission which is more than 5% but in the contract, they provide us only 2% stating that this contract is as per the DLD and that the difference between these two percentages is agreed on an email basis.
Is this really the fact that the Dubai Land Department is limiting developers on how much they can give commission to the (international) brokers?
In the contract "as per the DLD" there are clauses that we cannot advertise units anywhere (not even online), but in reality, we received info that again we can still do that, but it is there just to follow the DLD layout.
To me as a business owner, this practice seems as a total shady activity when we will agree on something via email which I will then deny by signing the main contract.

Used director's ID for real estate deal; agency denies payment

Q: Dear Sir/Madam,
My broker card/ID, which is used to create contracts, was still being processed when I made my first deal using the director's ID, as he was the only one with an active and ready-to-use ID.
Now, the agency is refusing to pay, claiming that the deal wasn't done by me, and their proof is that it's not under my name.
How can I respond to this?

Liability for the unpaid loan 31
I was jailed for 4 months for not being able to pay a loan from a Dubai bank since I've lost my job in 2011.
After my release, I tried looking for a job but was unsuccessful, so I went back to my home country when my visa expired but still the bank is sending emails and threatening me and wants to collect money from me.
Now that I am back here in Dubai, they threatened to file a ban against me and told me that I cannot get my visa renewed if I will not pay them.
Can the bank do such THING? I already have accepted the punishment of serving jail time since during that time I didn't have a JOB and was totally broke. What can I do so that they will stop harassing me?
What does the law say if someone had served the sentence for a bouncing check case?
