The required documents to collect funds from a deceased bank account

Hello everyone,

Good day to all of you!

My father recently passed away (may he RIP) in Canada, I just found out he has a bank account in Dubai and would like to understand the procedure to collect the funds and close the account. We are Muslims as I understood that this might change the procedures (?).

I am looking to hire a lawyer to help out with the above. I just need to know exactly what documents do I bring with me from Canada.

I have the following already attested and certified by the Canadian Ministry of Foreign Affairs and the UAE Embassy in Canada:

1) A will issued in Canada.

2) Death certificate.

3) Power of Attorney from my siblings.

Dear Questioner,

Kindly note the below, as general points:

A. Death Certificate.

B. Family member certificate or similar certificate show the heirs relationship to the father.

C- Heirs have to issue a power of attorney (POA) to you to do the transactions.

* All the documents to be attested by UAE Embassy in Canada.

* Ensure that the POA is vetted by a lawyer prior to attesting it to be sure it will be sufficient for you to do the transactions in UAE.

Hello Mohamed,

I hope you can answer just a couple more questions regarding your reply:

1) Can we use our birth certificates as proof of fatherhood? And if so, can I use a certified photocopy of the document instead of the original?

2) How do I ensure that it is properly prepared? What should be in the POA to make it usable in UAE?

(1) You have to have the original one attested from UAE Embassy in Canada.

(2) Yes, but again all documents have to be original. Also, you have to provide proof about the wife and/or mother as she is one of the heirs.

(3) You have to ensure that the POA is drafted with all the authorities that will be needed to do all the process, dealing with bank, acting on behalf of other heirs, receiving their shares and the words used are as per the common language used in UAE such as name of courts, stages of litigation and etc.

Note: It is better that you issue a POA to the lawyer and to you, where the lawyer can finish all the processes within the UAE and you can receive the funds on your name and deal with banks before you attend to UAE, otherwise your expenses will be much higher than lawyer fees to handle the matter.
