Q: Dear Sir/ Mam,
I am staying in Sharjah. We stayed in the same flat for the last 2 years. Our contract is ended on May 5th. But as we are migrating to another country we requested our landlord to stay here till June end 2 months back. He agreed to the same at that time.
Now he is asking to give 3 months more rent from June as a penalty to settle the things. Our contract already finished now.
Please advice what to do as we are not in a good financial position to give 3-month rent without staying.

Q: Hello,
I live in Dubai and have recently been sent on unpaid leave until further notice due to COVID-19. I am unable to pay my next rent cheque which is due in July.
I would like to exit my tenancy contract early, it ends in March 2021. My contract states that I am liable and have to pay an early exit fee of the equivalent of 2 months rent if I decide to leave early.
Can this be voided due to the current situation? And would I be able to leave without paying this?
Does COVID-19 count as Force Majeure? If it does, would I also be able to get my deposit back?

Terminating the tenancy contract without giving a complete notice period

Q: I was staying in an apartment in Abu Dhabi for 6 years. This year I decided to shift the apartment. I gave 51 days' notice in place of 60 days (2months) for not renewing my contract.
The landlord company forced me to deposit 9 days rent and took all of my security deposit as a penalty for short notice period without my agreement.
Now, they are refusing to give a receipt for 9 days rent and my security deposit settlement.

س: السلام عليكم ورحمة الله وبركاته،
أردت أن أستفسر عن أحقية المالك في المطالبة بإيجار شهرين بسبب عدم إخطاري له كتابيًا لإخلاء الشقة.
علمًا بأنني ذهبت للمكتب الخاص بالبناية وأعلمتهم شفهيًا بأنني لن أجدد العقد ولكن لا يوجد ما يُثبت وقد انتهى عقدي بتاريخ ٢٧ فبراير وانتقلت إلى شقة أخرى.
عند ذهابي لتسليم المفتاح، رفض وقال إن عليّ دفع شهرين لعدم إبلاغهم بالإخلاء.

I was overdue for my tenancy contract renewal; no one contacted me, and the contract expired 2 months ago. I have been living in this apartment for 2 years, and now the owner of the apartment wants to raise the price.
I read that I had a grace period of 90 days to renew my contract, but the agency says that I only had 15 days.
Who is right in this situation, and can I renew the contract at the old price?

Q: Dear Lawyers,
Is it legal for a landlord in Sharjah to terminate your lease contract after only one month due to some tenants not liking the smell of your cooking?
Additionally, is it legal for the notice to vacate to be only 25 days? Furthermore, can they charge you rent for the number of days until you provide SEWA Clearance?
How can I lodge a complaint against this landlord in Sharjah?

Can I put a financial guarantee to remove a travel ban in a rental case at RDC? 0
I used to work as a manager in a company, and my name was removed by the Dubai court of execution.
Now, on the paid rent, I got a travel ban, which I objected to at RDC.
The RDC accepted and gave the next hearing date, as I will have all the court papers.
Is there any way to remove the travel ban, as the objections I made at the execution hearing are next month, almost one month?
Is there any way you can put the amount as a deposit, and once the objection case is over, you can take it back?

Hi there,
My husband and I are Muslims. My husband passed away recently.
We have a Canadian will, but I understand that it won’t be honored as I am named the sole beneficiary, and that does not align with Sharia laws in the UAE. He was not a UAE resident but had a small apartment with no Will in the UAE.
We have 3 children. I am planning to go to Dubai to start an inheritance case. I don’t know the exact order of events and what needs to be done first.
1) Do I initiate anything from overseas before making travel plans to Dubai, or do I start once I arrive in Dubai?
Mind you, we cannot afford to stay in Dubai for too long, as the kids have school.
2) Do I need a lawyer, or can this be done by myself?
3) I understand all foreign documents need to be authenticated before presenting them to the court. But I don’t know at what stage I would need these documents authenticated.
I would appreciate it if you could provide a breakdown of the steps, the forms that are needed, and where I can find them.
