ضمان نقل الممتلكات إلى الأسرة بعد الوفاة

لدي بعض المدخرات في البنوك وسندات باسمي بالإضافة إلى مكافأة نهاية الخدمة المستحقة لي من الشركة.

أعمل لدى إحدى شركات القطاع الخاص في إمارة دبي منذ عام 2013. لدي طفلان قاصران وزوجة في دبي.

هل يمكن لأي شخص أن يقترح أفضل خطة ممكنة لحمايتهم إذا حدث لي أي شيء؟

Hello,

It is very important for non-Muslim expats in the UAE to have a Will to ensure their assets are handled as they wish.

In the absence of a Will, the default is Sharia law. Without a Will, you risk the following:

1) your bank account, even if joint, can be frozen.

2) default Sharia guardianship will be applied.

3) your properties will be distributed as per Sharia.

You can have a joint account with your wife to enable here to access your bank account. This will not help them accessing the fund, but they have to go through court first.

For the national bonds, they can have access to it through the court as it does not seem urgent to sell them and it can be held for 2-3 months till they are authorized to sell them by the court.

You can issue a Will for your assets if you are not a Muslim and you don't want to apply the Sharia law to your assets.
