Yes, I do need to get a divorce from my husband. He wants a divorce as well he says, but he has refused to do his Talaq. I am not sure why, or if this has something to do with money.

If I go to a Sheikh in Stockholm (Sweden, where I live now) to get this marriage nullified, would this mean that he does not have to compensate me, not even my Mehr?!?

We have been married for nearly two years, but he has never given me any financial support or maintenance whatsoever as required by Islamic law as I understand it.

No, we do not have any kids together. I have a five-year-old boy from a previous relationship, whom my husband said is his son and that he will take us both to Mecca and Madina (KSA) for Hajj and that my son will start English International School in Dubai (we speak English together) and he will also attend Quran School and learn Arabic and Islam...etc.

Q. How much would this cost me? Would it be worth it financially (travel to/from the UAE and hotel...etc.)?

Dear Sari,

If you proceed Talaq in your country (it is called Kholaa - divorce), and if you could not prove how he harmed you as well, as per Sharia, in the case of Kholaa, you will never be able to get your Mehr.

But, if you proceed Talaq in your country and succeeded to prove how much your husband harmed you so that you will be able to get your Mehr and other alimony.

Now the question is if you proceed Talaq by your city Sheikh, how will you enforce it here in the UAE?

The answer is easy. To get that by registering an urgent order to Sharia judge and you will get the execution decision within 48 hours. Then your husband will be entitled to pay by legal force.

Regarding his nonpayment, in Islam (Holy Quraan & Hadith) it was mentioned there that your husband should pay you daily, weekly or monthly for your wares, and he should pay for his children (Food, medication, clothes, transportation, schooling...etc).

Moreover, he is obliged to offer rent home for all of you for accommodation, this is what Islam says.

As long as your son is not his son, he is not obliged to pay him.

But your husband has to pay your Mehr, Edda, and Motaa.
