حقوق الموظف في حالة الإقالة التعسفية

أعمل بقسم الموارد البشرية بإحدى الشركات الخاصة منذ 12 عامًا. وفي الأسبوع الماضي، تلقيت رسالة من مدير قسم الموارد البشرية ينهي فيها عقدي لتقليل العمالة على حد قوله.

لكن السبب الحقيقي هو أنني أرسلت رسالة إلكترونية إلى قسم الشكاوى بالشركة ضد مدير الموارد البشرية وشكوته، وقد علم بذلك.

لم يتلقى غيري من موظفي قسم الموارد البشرية هذا الخطاب، وقد ضموا موظفًا جديدًا ليحل محلّي.

هل يمكنني تقديم شكوى ضد الشركة أمام محكمة العمل؟

Dear employee,

The employer has the right to terminate the contract any time for a valid reason. If the reason to terminate is not valid, depending if your contract is limited or unlimited, you are entitled to compensation besides the end of service benefits.

Your employer cannot be forced to employ you.

3 months.

1) Only if you have worked there for over one year, you are entitled to severance pay on termination (ARTICLE 132 of the UAE Labour Law).

2) Leave - The employee is entitled to two days per month (as the employee worked more than six months and less than one year of service and 30 days if more than one year (ARTICLE 75).

3) You can claim before the Ministry of Labour three months’ salary or the remaining period of time (whichever is lower), as a compensation from your employer because:

  • The employer broke the contract- if it's a limited contract (ARTICLE 115), or
  • Arbitrary termination- if it's an unlimited contract (ARTICLE 123)

4) Air ticket only if you are going back home and not going to join a new employer (ARTICLE 131).

5) Notice period- 30 days (ARTICLE 117).
