Liability for hitting a pedestrian crossing the street illegally

I have this question. A pedestrian was crossing the street illegally then he hits from the side with my brother's car. My brother called the police right way, that guy had a facial fracture.
The police arrested my brother. Even that guy didn't file a case against my brother. My brother follows all the rule. He has insurance and all stuff.

I believe that the police officer has taken a decision based on his authority and sense of responsibility to take a preventive measure to ensure that your brother as - may be responsible - of the accident would not escape even if he is the one who called the police dept.
So, you should follow the investigation and the medical report issued for the pedestrian who was injured and of course was not in a condition to make any calls to report the accident.
The coming few hours will make things clearer if there are any charges against your brother or not.
