Q: I am into diesel trading business. One of my customers owes me AED 144,500. He issued me two cheques of 100,000 of each. He told us he had 10 heavy vehicles.
We supplied diesel to him for two months. He defaulted on payments and stopped answering calls. After this default, I inquired with one of his drivers and he told me none of the 10 vehicles is owned by him.
He along with his colleagues, present themselves as a transport company and defraud the diesel supplier by issuing post-dated cheques to them and selling the diesel purchased in the open market at half the price.
I have already filed a cheque bounce case against him. Apart from the cheque case, can I file a cheating case against him?
If possible, what are the documents required to file such a cheating case?

Criminal liability and civil liability in cheque bounce cases

Q: I have recently filed a criminal case against a customer for AED 1,300,000.
I have found out that he has given an application to the court to get a fine on this bounced cheque amount. Is it possible to be fined at this amount?
How can I proceed further to place a travel ban on him and ensure that he does not get fined? It has been 5 years since this liability is due.
Please help me on what I should do next.

Q: Hi Mr Naser,
Thanks for your fast response. We are based in Abu Dhabi.
Q.1 As we know that for a rent cheque bounce after the police case is closed and the civil case is opened, will the judge decide on the amount for instalments in this civil case? Won't he consider what we say how much we can pay?
Q.2 During eviction case, when the rent/lease expires and since the lease is now connected with Tawtheeq which expires as well, will ADDC cut my electricity during this time?
Q.3 My friend has a bank loan of AED 60K approx from a bank here in the UAE and he did not pay for the last 7 or 8 months. This bank has a branch in Pakistan.
If he travels to Pakistan due to an emergency and the bank proceeds with its action, what action(s) will that be? (So far no action from the bank)
Q.4 If he goes to Pakistan, what will be the consequences for an already running civil case of a bank loan default?
Q.5 for a credit card security cheque bounce, can a bank directly file a civil case?

The landlord got a municipality order against me to pay pending rent and vacate. What to do?

Q: The rent is 3300 and he said the cheque return is 1050, and the open case file is 1000 while the closed case file is 2100.
I told him to allow me to split the payment; first I would pay the rent and pay the legal fees with one cheque, but he said no that I needed to pay the full amount at once.
So I told him I don’t have that amount now that is my fate.
He told me to wait for the next hearing and that I would receive another notification from the municipality office after a month that after then they would tell me what to do.
I believed him and I was waiting for the second hearing until I received another letter yesterday from the municipality giving me seven days to pay up and vacate the flat.
Please, what can I do?

Bank filed a civil case over a loan: Better to settle with the bank or in court? 0
Good day, Sir,
I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?

Demanding that an employee pay for visa charges a year after resigning 0

I worked at a bakeshop here in Dubai. I resigned exactly one year ago. Now they want me to pay for visa charges, as stated in the offer letter.
If I cannot pay for the charges, my employer will claim financial loss due to the damages, estimated to be at least 7,000 AED.
What should I do about this? My monthly salary is only 2,800 AED.
