Requirements and procedure for filing a bounced cheque complaint

I have a cheque of AED 35000 given by a person and it bounced. What is the procedure?

I have already complained at the police station. What if I file a case against him? What is the procedure and what are the legal actions to be taken against him?

Hello,

As per Article 401 of the UAE Penal Code, a person who issues a cheque in bad faith without sufficient funds or after giving the cheque withdraws all or part of the funds, so that the remaining balance is insufficient to cover the amount of the cheque, shall be sentenced to detention or a fine.

In order to file a case for a bounced cheque, one must formally lodge a complaint with the police of the respective emirate. In an on-going effort to make this process less time consuming, a complaint can now be filed through the Dubai Police mobile application.

Once you choose the “Report Bounced Cheques” tab, you will then be redirected to a page where you will be required to fill in details such as:

- Applicant’s details (Emirates ID number and Email address);

- Cheque Details (Bank Name, Account Number);

- Police Station (A branch to be chosen from the list of options given).

You will also be required to upload an image of the bounced cheque along with a summary of your complaint. Once this process is completed, you will receive confirmation from Dubai Police and will notify you about when to visit the police station.

The police will require the original cheque along with a copy and proof of identity.
