Q: I am an Indian Muslim woman seeking a divorce with my Indian Muslim husband here in Dubai. We have a 2.5-year old daughter.
1. My husband is saying that since he is the guardian and he will provide accommodation for my daughter (and me), my parents will not be allowed to live in that house when they come to visit me. Is this true?
2. My husband is also saying that if I relocate to a different country, he will get the custody of my daughter.

The rights of a father upon divorce

Q: I have given divorce to my wife on 3 multiple occasions as per her wish to force me to give her divorce verbally, then she came to Dubai on a visit visa along with my kid.
She has requested me to sponsor her with a wife visa just for few months. She has convinced me and I sponsored her with my kid.
Now for 2 years, I am telling her to cancel the visa as she promised but instead, she is blackmailing me. During these 2 years, I took all my child's expenses. She is trying to get the child's full custody and she will not allow me to meet my child.
Even now she blocks all my contact and shifts her house to another area.
Kindly advise!

Understanding the rights of the husband during divorce

Q: Hi,
I’ve been married for 7 years with two beautiful children and we are expats living in Dubai (British).
We decided to get divorced and I wanted to understand my rights in regards to the family name as she’s in media and uses my children as pawns on social media sites.
She also puts up pictures that I don’t want to be associated with my family for legal reasons (alcohol-related as she doesn’t have a license and hosts paid media events illegally).
Can I force her to change her surname? Do I have any rights over what pictures of my children are put up on media platforms? Do I have any rights over my family name relating to social media?

My ex-husband got married. His wife has a kid from a previous marriage who stays with them, and my kid goes on weekends to stay with him as per court order.
My question is in case my child faces any abuse or attack from his wife and kid, what can I do?
Can I file a police case or file a case in court?
Can I stop his father from taking my child to his apartment?
My child is 10. Please advise.

Q: A judgment has granted sole custody of the minor daughter to the father (Plaintiff) and ruled to prove the plaintiff’s custody of the little girl.
This does not prevent the right of the defendant (Mother) to see her, visit her, and have her visit him, as will be stated in the operative part.
And since the fees and expenses include attorney fees, the court obliges the defendant to pay them in accordance with the text of Article 133 of the Civil Procedures Law.
1. Does the plaintiff have the right to deny the mother taking the child to her place for an overnight stay and only approve supervised visitation?
2. What must be the frequency and duration of supervised visits and video call facility allowed if the child is 8 years old?
3. Does the plaintiff have the right to deny entry to the home without his consent and request the defendant to pick up and drop up the child in the building reception?
4. Can the plaintiff request the defendant to use the appclose application to schedule visitation and video calls?

My trade license and visa will expire next month, along with my Emirates ID.
Is it possible for me to renew my license and visa along with EID prior to settling the execution cases?

How can we claim our money back if the cheque we received have bounced for insufficient funds? 0
We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day.
We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds."
We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it.
We are not sure what we can do. We need the money asap to pay our kids' school fees, let alone all the interest we have lost.

Hello,
I want to inquire regarding my leave privileges. I am now 11 months in my company. How many leaves am I privileged to?
Based on Decree-Law No. 33 of 2021 regulating labour relations and its executive regulations, you are entitled to a paid weekly rest for not less than one day, as specified in the work contract or the work regulation.
The Council of Ministers may increase the weekly rest day stipulated in this article. The Decree-Law and its executive regulations also stipulate that you are entitled to an annual leave with full pay as follows:
- Thirty days for each year of your extended service.
- Two days per month in respect of any employee with more than six months and less than one year of service.
- Leave for parts of the last year of your service in case it is terminated before you use your annual leave balance.
Now my question is: do I have 22 days I can use? Can someone explain to me in detail?
