إلغاء تأشيرة العمل في حالة وجود قضايا معلقة

مرحبًا يا فريق العمل،

 لقد انتهت مؤخرًا خدمتي بعد قضاء عامين في العمل، وعند إلغاء التأشيرة، علمتُ أن هناك قضيتان مرفوعتان ضدي.

تريد الشركة في الوقت الحالي رفع قضية هروب ضدي حيث قالوا إنهم غير قادرين على إلغاء التأشيرة.

هل يمكن التوصل إلى حل مع صاحب العمل بدلاً من رفع قضية الهروب؟

Dear Questioner,

In case you are still in the UAE, they can cancel your visa without filing an absconding case against you.

In case you are outside the UAE, they cannot cancel your visa without having your original passport and the only option for them to cancel your visa is by filing the absconding case.

Kindly note that once there is an absconding case filed against you, you cannot travel in or out of the UAE because you will be caught by the police.

I suggest you speak with your employer to cancel your visa without filing an absconding case. In case they rejected your request, I suggest you open a labour case against them.

Please note that in order to be able to file a labour case, you need to claim some entitlements which have not been provided by the company (eg: end of service gratuity, last salary, notice period salary, vacation leave...etc).
