What can a UAE expatriate do with assets and properties in case of deportation?

Hi,

I have purchased a property in the UAE and opened a business here.

If I get into any trouble and they deport me for any reason, what will happen to my assets, houses, business and money in the bank?

Am I able to transfer them out or sell them and send my money back home?

Dear Sir/ Madam,

Thank you for reaching out to me on this.

I understand your concern and appreciate that you would take precautionary steps to secure your assets in the UAE.

You may hold assets like house, bank accounts, shares in a company... etc in the UAE. If you are deported from the UAE, you can issue a Special Power of Attorney from your home country to a person in the UAE who will have the power to withdraw money or sell the shares/ house on your behalf.

You will have to note that this person can also take the money on your behalf so the person you give power to should be someone trusted and within your close circle.

Giving a Power of Attorney from the home country goes through a series of stamping and attestation which could add to costs.

Instead, if you are in UAE, you may consider preparing a Power of Attorney giving powers to another person to deal with the assets like an owner.

How much does it cost to make a POA in the UAE?

And if I am with my wife here, I can do it while I’m here. It will be easier to do so.

Yes, I agree since you are in the UAE, to prepare and notarize the POA will be quick and cheap for you.

The Notary charges for POA are AED 220/- (Please check the recent charges as the government keeps varying it) and the Lawyers fee to prepare a POA is very case specific as there are no set formats. Every POA is to be drafted for individual needs.

Dear Questioner,

Appointing an attorney will be your option in case you were deported.

In addition, if you are a non-Muslim you should be considering drafting and registering a Will in the UAE for your assets.

Otherwise, the inheritance will be distributed as per Sharia Law, regardless of religion or the home country inheritance laws.
