Q: Hi,
I lost my job due to restructuring this week. I requested to consume my annual leave before the notice period.
As such, I haven’t been handed over my letter of redundancy/termination (something I do not have clarity on). I have had no performance-related issues as I have had great ratings in my 25 years of service.
I do hear that my job has been offered to a team member that reported to me and has been put on a trial basis. The company has changed to one month notice period since last year.
It used to be three months until March 2020 but Covid19 and poor business are now used as an excuse. What are my rights as an employee under termination/redundancy conditions?

Q: I am writing this mail to clarify my redundancy termination and end benefits. I had been working with a construction and maintenance LLC from the period of 01-09-2015 to 15-04-2020.
I have received a termination letter on 15-04-2020, the reason mentioned is due to redundancy. As informed by the company HR department, I am eligible to get one month notice period salary and end benefits.
Could you please make me understand the below query in conjunction with the UAE labour law?
In redundancy termination as per the UAE labour law, is the employee eligible for any kind of compensation apart from the notice period payment?

Q: Hello Dr Al Bastaki,
I was made redundant last week. The employer stated it was NOT due to any performance issues but due to the reason of no projects coming up in future, so the need to cut the costs of the business.
I believe it is an arbitrary redundancy because it is not a performance related issue. Am I correct in thinking this way? What are my entitlements, if any, for compensation?
I have an unlimited contract.

Q: Hi.
I have not gotten an answer to the same question.
I joined a company more or less 4 months ago, and I have seen illegal manipulations happening to the staff. I am thinking of resigning.
Now, I wanted to ask about “Article 4 (Additional Terms)” in the MOHRE contract, stating if I terminate the contract within 1 year, I have to pay 3x of my salary plus a ban of 1 year.
And I am not allowed to work in any competing company for 1 year. Is this valid?
The 2nd question, the company had forced me to sign the MOHRE contract without a probation period (I didn’t know they could even remove it), which was also stated in my company offer letter that I will have 6 months.
Please, I really need your help.

Is the employee entitled to benefits and ticket in case of termination during probation?

Q: Hello Sir,
I have an issue and that is my company terminated me within the probation period by article 44 without any notice.
I just wanna know if there are any benefits because of termination. Did they have to give me a ticket to my country or a salary of half month?
Because they do not agree to give anything nor ticket nor half month salary.

I want to resign. Do I have to pay 2 months salary as a penalty?
Can I negotiate with my employer to have this waived?

Registering an execution case after winning a payment order 0
I need to register an execution case since I won a payment order (Amr Ada) Case.
A) Is there a special format to use when registering the execution case file? or can I type in my words in the online process for smart case registration?
B) What is the cost of the execution for the Amr Ada case? I need to claim that amount as part of my total, but I don't know how much this will cost me? Is it a fixed cost or is it a percentage of the executed amount?
C) The honorable court had earlier decided to give me a fee postponement of Amr Ada court fees since I am 80 years old. Then the respondent lost the Amr Ada lawsuit and he will have to pay the court fees.
Will I have to pay for the execution case filing? Or the letter I got for court fee postponement will apply to the execution case as well?

Filing a false case against an employee in order not to pay his dues 0
Sir,
I am working in Dubai as a sales representative with 1000 as basic salary in the contract. I submit my resignation on 15/09/2020 with 30 days notice period.
The company asked me to hand over the job on 01/10/2020. I handed over the company car, SIM, and laptop. On 11/10/2020, the company filed a case against me that I deleted all company emails.
They filed a case in labor court. They don't want to pay me September month salary + 6 years final settlement +1 year leave salary. Also, They don't want me to join a competitor company.
That's why they filed the case. I do not have money for food. My 4 member family in India depends only on my salary. I don't know what to do.

Obligation of the cheque signatory when he wants to leave the company 0
I am working in a tourism company in Sharjah, the 100% ownership is with the sponsor. The company started in March 2019, after 3 years only, to change to LLC as per the license.
The sponsor gave me power of attorney to open a bank account so I am signing on cheques and all is going perfectly.
My company has 7 partners and they took various letters on the company letterhead and stamped for mutual agreement, and also my 2 blank cheques and one checkbook are with them.
Please advise, is there any issue if I quit the company?
I want to repay AED 50000 to the company because I paid credit to customers still not received, and I will pay but need few months time to repay the same. They threatened like talking more.
