Extending the notice period in unlimited contracts

On an unlimited contract which says 3 months notice, the employer has taken in writing 6 months notice separately.

My friend gave notice. 4 months passed and he wants to leave the UAE urgently. The employer is holding his passport and not releasing it.

If the employer gives a labour ban, no problem, but he wants to avoid a travel ban. What are the options?

Dear Questioner,

Thanks for writing to me directly.

Please note article 117 of the UAE labour law which states that either the employer or the worker may terminate an indefinite term contract for a valid reason at any time following its conclusion, by giving the other party a notice in writing at least 30 days prior to termination. Even if the period of notice is 3 months in the agreement, the agreement is valid.

Three months is the maximum notice period prescribed. You may raise a complaint in the MoL regarding this.
