Q: Hi,
I needed to know if the court issues a judgment of 2 or 3 months jail term in cheque bounce case, is there a way to reverse the judgment or avoid the sentence? Possibly if the creditor withdraws the case?
I have received a judgment of a jail term of 2 months for AED 1 Million security cheque bounce against a loan that is 75% paid off and a 3 months jail term for multiple cheques to a single supplier valued at AED 48,000.00 approx.
What can I do avoid jail terms and wondering how AED 48k cumulative value would result in jail term?
Appreciate a solution for this.

Q: A cheque bounced with an amount more than 1 million Dirhams but there's no legal agreement with the party.
Questions:
1. If a case is filed against the cheque issuer, what will be the court stand?
2. How much time does it take by the court for judgement?
3. In whose favour will the judgement be?
4. Can the cheque issuer file a case against the borrower as there's no agreement with the party? And what will be the outcome?

Speeding the procedures of a criminal case for bounced cheque

Q: I have filed a case on a bounced cheque of 1.3 million AED. This is a criminal case filed in Sharjah, UAE.
It's been two months and this individual has not been arrested yet. Furthermore, he is operating his business as usual and earning good profits.
What is the procedure to ask the court to seal his business premises so he is pressured to pay?

س: السلام عليكم،
أتعامل مع شركة منذ سنوات بالشيكات الآجلة، ولظروف معينة ارتجعت شيكات لي واتفقنا على السداد بالتقسيط وفعلاً سددت 12000 درهم.
تفاجأت بوجود بلاغ بقيمة 50000 كاملة. تم توقيفي وإيداع جواز سفري في قسم شرطة الشارقة البحيرة وتم حظري من السفر. عندما تواصلت معهم طلبوا مني تسديد المبلغ البالغ 50000 في قسم الشرطة لرفع البلاغ ومن ثَم سعيدون المبلغ الإضافي 12000 درهم لي نقدًا!
هل أستطيع تحويل الموضوع إلى المحكمة المدنية؟
وفي حال أمكنني ذلك هل يتم رفع منع السفر عني؟

The penalty for bounced cheques of high amounts

Q: Hi,
We have a bounced cheque case registered against us for AED 1.5 million in Umm al Quwain and AED 200000 in Fujairah at the police station.
We would like to know the procedures of the police station and court for these two emirates.
Do they provide a fine as punishment or jail term? Can we request installment payment?

I have two criminal cases for cheque bounce in Al Ain Court for the same party; the first case amount is 1,006,000 AED (13 cheques) and the second case amount is 400,000 AED (one cheque).
What will be the possible action against me? Prison or fine?

Responding to a case filed by the employee for non-payment of dues 0
One of our employees has made a case against us for the non-payment of the final settlement.
While discussing the final settlement before the case filing, the employee had refused to hand over the company laptop and data therein before the payment of notice period salary of 3 months.
We have a limited contract with the employee under the Dubai Silicon Oasis Authority. The employee was hired in August 2018 and terminated on June 2019.
What protection do we have to claim against the employee for unauthorized taking away of company property?
Can the court decide ex parte on this case?

Filing a case against the husband for denying maintenance 0
I was told in Sharia Court that I can file a case if my husband does not provide financial support for my kids' food, groceries, clothes and allowance for me.
His reason is that I have my own work then I have to share the expenses. He does not live with us and has another wife in Dubai.
What is the process and are there any legal complications against me if I choose to file a case against him?
I do not want this issue to become messy and involve my children.
