حساب المكافأة بسبب إنهاء الخدمة قبل إتمام سنة واحدة من العمل

أنا مدرس ولقد عملت في إحدى المدارس في إمارة الشارقة.

أريد أن أسأل: هل يحق لي الحصول على مكافأة نهاية الخدمة أم لا؟ لقد بدأت العمل في المدرسة في 3 سبتمبر 2018 وانتهى عملي في 11 يوليو 2019.

Thank you for contacting us.

There are two types of contracts, limited and unlimited. You have not mentioned your contract type.

As mentioned above, you have just completed 10 months of your service. Basically, less than one year service is not eligible to get gratuity.

To better understand the situation, just go through the provision of the UAE law mentioned as follows:

Calculations for a limited contract gratuity pay

Less than 1 year of service:

Leaving work before completing one (1) year of service means that you are not entitled to any gratuity pay or final settlement.

Between 1 year and 5 years of service:

The employee is entitled to full gratuity pay based on 21 days salary for each year of work.

5 or more years of service:

The employee is entitled to full gratuity pay based on 30 days salary for each year of work.

Calculations for Unlimited Contract gratuity pay

Less than 1 year of service:

Not entitled to any gratuity pay.

Between 1 year and 3 years of service:

The employee is entitled to one third (1/3) of the 21-days gratuity pay.

Between 3 years and 5 years of service

The employee is entitled to two thirds (2/3) of the 21-days gratuity pay.

5 or more years of service

The employee is entitled to full 21-days gratuity pay.

The contract is unlimited and they terminated me without any reason and they will give me the salary till August 25. I did not resign.

If they terminated you without any reason, then you are entitled to claim compensation from your employer and make a complaint to Tasheel and MOHRE.

Only if you have worked there for over one year, you are entitled to severance pay/gratuity on termination (Article 132 of the UAE Labour Law).
