Q: Hi Sir,
I worked for a travel agency for 3years, as accounting manager; when wanted to come back to my home country I resigned from my job in July 2017. My employer didn’t pay my dues and didn't make any final settlement amount.
Being trusting the manager I signed the end of services form for visa cancellation. He promised me to make the payment once the visa is cancelled, but after cancellation, he started harassing me saying I have manipulated his accounts and stole his money and tortured me.
Finally, he made me sign a document that I have adjusted amount which was approx 50,000 Dhs, for my mistakes in white paper and gave my passport and I left Dubai in July. I have 1 loan of 30,000 and 10,000 credit with banks, who are after me to make the payment.
Is there anything I can do to get my money? Pls, help me I want to clear my dues in Dubai.

Q: Employee Waiver Agreement, is it legal?
Our employer did not pay our final salary and end of service gratuity. They demand that we sign this agreement, and if not, we were told we receive no money.
After signing the waiver, the employer has not paid. It appears they never planned to pay. They planned to show the document in the court.

Destiny of the customer's cheques issued before the closure of a company

Q: I wrote out post-dated cheques to a removal company.
This company has now been closed by the DED, and their license expired in July 2017. This has not been renewed and it has all been confirmed by the DED.
I cannot get my cheques back from them as there is no one to contact. I am afraid however that they are still going to try and encash the cheques, which have been made out to the company and not an individual.
What do I do please? Dubai Police referred me to Dubai Court but I have not been successful with either of them.

Holding gratuity and labor entitlements after resignation

Q: Hi,
Good day.
I have been working with a company for 5 years and a half. Then I applied for my resignation (with a 1 month notice period as per my contract) and my service ended on June 30, 2018.
A month after, my manager contacted me and asked me to sign some "pre-termination" paper. When I asked about my gratuity payment, He mentions that I can get it within a month or two and that if I still didn't receive it, I can still have grounds for complaint that I can submit to the Ministry of Labour.
However, I still declined to sign any letter. They then just told me that they'll contact me if ever the cheque is ready.
My question is:
- Was my action right by not signing any papers considering I had no guarantee of receiving my gratuity?
- Also, since I'm still looking for a job currently (and I want to settle things amicably), is it an option for me to simply just wait it out until they contact me again with regards to my cancellation and gratuity?

Refusing to return a security cheque after securing the loan with another

Q: I issued a security cheque to my company owner for another employee loan who did not have a bank account at that time.
Now, the same employee has a bank account and a cheque book and he has issued cheque against his loan to the company, to which I issued cheque before.
At the back of both cheques (Issued by me and another employee) mentioned that cheques are only for security purpose against the employee loan.
My owner is refusing to return back my cheque. What should I do?
She is now holding 2 security deposit cheques against 1 single amount of loan.

Q: Hi Sir/Madam,
While I joined our company, they got a security cheque (Blank dated) from me. When the staff leave their job, the company gives less amount for settlement.
If we ask for the correct settlement, they threaten us "if you ask more, will we deposit the cheque" like that. Suppose they deposit the cheque and bounced, what will happen?
I have only a cheque copy. I don’t have any other proof. Can you tell me how we can be relieved from this issue and get the full settlement?

An employee issued a security cheque on behalf of the company, what to do?

Q: Hi,
I had given a security cheque of AED 5000 on behalf of a company I was working for as at that moment the owner was in the process of changing the bank account.
Therefore on goodwill, I had given my personal cheque. I left the company and now the company is not paying the service provider and therefore the service provider has deposited the cheque even though I clearly asked them not to, as I am not part of the company any longer.
I have now asked the service provider to return back my cheque and to send their collections team to the head office to get their payment sorted.
Is there any way I can take this matter to the police as the company is still running and the owner is still around?
All invoices were issued under the company.
I would much appreciate your assistance on this matter!

Q: Hello,
Can you help me with a complaint against my company in MOHRE?
The complaint is I have a cash advance of 7000AED from them. They forced me to sign this paper before they hire me in the company, now they want me to pay the 7000AED.
I didn't receive or borrow money from this company. They are holding also my passport. They don't want to give it back until I pay the 7000AED. I didn't resign my contract with them, they didn't terminate me as well.
Please give me some advice.

The employer took my signature on a loan I never took to pay visa expenses upon resignation

Q: Can an employer get a signature on a loan paper for giving them a job & after resigning asks them for visa money or else they will file a case against the loan amount?
Please guide me, in such a case, what should that employee do because they hold the passport?
They cancel the visa & do not give the canceled paper so the employee should change the status to avoid a fine. They just keep on blackmailing me to get the visa money in terms of the loan paper.
Is there any possibility to show the bank statement that we never received such an amount?
Or the employer never has the cheque receiving, but just the loan request paper?
Can you please guide me?

Refund of a deposit paid by the underage buyer of real estate property 0
I put a deposit down on two "off-plan" properties. I paid a deposit on both and received a reservation document signed and stamped by the developer.
However, at the time of the deposit, I was under the age of 21 which is the minimum age to purchase property in Dubai. Lastly once the deposit was made I never received an SPA or NOC. Have now been sent a notice by Dubai Land Department on the request of the developers for Property Termination procedure. The request was canceled.
I am now trying to figure out how to get my deposit back as I believe since I was underage and no formal contract was presented or signed, the agreement is void.
