Alimony for the wife upon filing divorce by the husband

I got married in Seychelles and we attested our marriage in Dubai. My husband had an affair and so he is divorcing me.

I don’t want to get him in trouble by declaring this but I want my rights to alimony. I don’t have kids with him and I am employed (UAE residence visa).

How much and how long is he supposed to support me?

He has to support you until you remarry.

Regarding how much money he must pay you, it depends on his salary.

Please note that the payment of alimony completely depends upon your husband salary. He has to support you until you remarry.

Pursuant to your queries, as a wife you are entitled to alimony and maintenance for yourself in accordance with the Personal Status Law of the UAE, the husband must maintain his wife in accordance with Article 63 of the Federal Law No. 28 of 2005 Concerning Personal Status which shall cover food, clothing the house, treatment, a servant for the wife if she is served in her family's house.

Does this maintenance include paying for the accommodation?

How does it depend on the husband's salary?

Will the wife lose her rights if she moves out of the house before the divorce is finalized?

Also, to claim alimony, does the wife need to bring it up when filing for a divorce? I am finding it hard to find information regarding the process of divorce.

Does the alimony amount also depend on the reason for divorce?

Also, may I please ask if I need to hire a lawyer to claim this alimony? Do I need to prove the reason for our divorce?

My husband decided on the divorce initially. But now it is mutual. Is there an impact on the amount of settlement I will get either way?

Hi there,

Maintenance can vary in different circumstances.

In case of mutual divorce, you don't really need to contest and prove any reasons but you may like to get your rights protected and safeguarded by legal representation.

In the case of mutual divorce, you both need to decide on the maintenance and its arrangements.

Regarding the decision making for the maintenance, doesn't the Dubai court decide on the amount of alimony needed?

If it was not a mutual divorce, what would be the implication?

You can decide whether it is a mutual or contested. Both are two different things and work differently.
