Refusing to pay the EOSB to an employee before cancellation of visa

My former company terminated my employment due to a lack of work and they are refusing to release my final payment until my visa is cancelled.

Don't they have to pay me then I cancel the visa?

Dear Questioner,

I very much understand your situation. Under the UAE Law, end of service gratuity/final payment is immediately payable on the termination of employment.

If your ex-employer is refusing to pay you, you can raise a complaint to the Labour Office and then to a Labour Court.

Furthermore, by law, they have to pay you all your benefits before cancelling the visa. If they did not cancel your visa, you can complain to the labour department.

Hello,

Gratuity and all the other end of service benefits should be payable at the end of the notice period.

Talk to your employer and explain your rights. If no amicable agreement was reached you can file a complaint at the Labour Department.

Cancel the visa, and in case they did not give you your dues, you can file a case against them and obtain your dues.
