Requirements for exemption from court fees in labour cases
Are the labour court fees mandatory?
Our lawyer filed the case for us in Fujairah and now the court wants us to pay AED 5000.
We asked our lawyer to waive the court fees for the case but after 2 weeks, we followed up and the secretary of the lawyer said to us that the court cannot waive the fees.
Our co-workers did not pay any fees in Abu Dhabi and Dubai courts where they filed their cases and now most of them received their judgment. Because of this, we are having second thoughts of our lawyer.
There has been no progress since we provided our documents and SPA 6 weeks ago. Are court fees really mandatory to be paid?
The secretary of the lawyer said to us the case will not push through if we will not pay. The thing is we did not receive 4.5 months of salary and the court fees are much of a burden to add.

Thank you for reaching out to me on this.
Please note that the court fees are applicable in two cases i.e. when the claim is more than AED 100,000/- or when the court appoints an expert in the case.
If your claim is below AED 100,000/-, there is no court fee levied against the case. However, at times, the court appoints an expert to look after the case and then the expert fee is payable.
I would advise that you get in touch with your lawyer and request for court issued order which demands this payment of AED 5000/-. If there is an order, then, of course, you should pay the same.
If you have any doubts about your lawyer and no work is done, then you can hire new lawyers.
