Q: Hello.
I have been working for one company a year and a half. Yesterday, I was told that due to redundancy they don't require my services.
The letter they gave me is extremely controversial- stating that my contract is terminated with immediate effect, and on the other side, I am asked to serve a one-month contractual notice.
So my question is, is that legal? Am I entitled for more than one salary due to redundancy? Do I have to work for the notice since its immediate termination?

Is it legal under the UAE labour law to dismiss someone for redundancy, in particular as this is not linked to restructuring, factory closure, business resizing...etc?

Q: Hello,
I am currently employed at a Private British School under an unlimited contract.
I was informed in March that there is not a job position for me in the next academic year and therefore I have been made redundant, however, I am to complete my contract up until August 2019.
The deputy head asked me to hand in a letter of resignation to which I refused as I am not the one who wants to leave my employment.
I was wondering due to the school making me redundant, am I entitled to 3 months additional salary once my contract is complete?
Where can I find information on this?

Q: Hi,
I worked for a bank in the UAE for more than 10 years and on Dec 16, 2018.
They gave me a letter of termination mentioning that due to the realignment of operating model, they don't want to continue my services and the last date of working to be Dec 31, 2018.
They also gave the option for me to resign. Since resigning would be a better option to get another job, I decided to submit my resignation and it was accepted and they relieved me by Dec 31, 2018.
Later I came to know that the UAE labour law suggests giving one month of notice before termination and 3 months additional compensation in addition to the notice period.
I want to claim the amount from my employer. Is it possible? I have the termination letter that they had given me.
Please advise.

Entitlements of the employee upon termination for redundancy

Q: My brother was terminated yesterday and the reason is to reduce employees upon instructions from our UK office.
He’s with the company for 3.9 years under unlimited contract and given the 30 days notice on 30.05.2019.
Is he entitled for 3 months salary compensation as per arbitrary dismissal/termination not related to performance?
He was advised verbally about this instruction and he was chosen. We would like to know his full benefits and rights, please.

Q: Hello Experts
I need your help to understand and tackle my unemployment in this difficult time.
I was working in an FZ company in DMC and my employer terminated my unlimited contract in January 2020 by giving this reason:
“The company is not making expected revenue, and to save the cost, the company has decided to outsource my job to one of their offshore offices."
I served my two months notice period which ended in March 2020 after that they paid my gratuity as per the UAE law.
Now they want me to sign EOS agreement stating “To this effect, I hereby undertake not to claim any compensation from the company on account of termination of the employment relationship.”
I cross-checked with the employer, termination is not due to my performance. They terminated my contract on the ground of the aforesaid reason.
I want to know, is this “arbitrary dismissal” as per the UAE law?
If yes, what are my rights and how can I claim them?
Can you please help to understand my case?

Unlimited contract termination due to COVID-19 without paying any dues

Q: Hello,
On 17th March, I have traveled to India on my annual leave (approved by the company) and I was supposed to return on the 10th of April but due to the Corona outbreak, all the flights were canceled so I am stuck in India.
Now last week, around 26 or 27th April, my company called me and they informed me on a phone call that, due to this unexpected situation, we are not getting any new business so we decided to remove you from my position at the company with immediate effects.
They have not even paid me my annual leaves. Now without giving any notice, they simply asked me not to continue with the company, and they are not ready to pay anything, giving an excuse for the loss of business.
I have joined this company in September 2019. My contract is an unlimited contract. Could you please let me know if I open the case against my employer, can I get the end of service benefits?
They also said we can continue your visa if you want to come back to look for another job.

I had an unlimited contract with them. 3 years visa and I have made more than 2 years now with the company.

Our internal contract has a notice period of 3 months from both parties. In the new labor implementation, only one month's notice is required for less than 5 years of service.
Please advise if we can follow our internal contract since the position is very curtailed and the organization will not be able to replace the position within one month.

Can you please clarify the correct annual leave salary rules?
Some say it is basic + HRA for the month you will take off, others say it is full salary, and somewhere I read it is basic + HRA (annual leave salary) plus the normal salary you get.

How to appeal the labor judgment if the court did not approve all my dues? 0
My employer has not paid my salary for 8.5 months. I went to the labor court, and was referred to Dubai Courts.
The judgment came and I did not receive the full claim including salaries and 3 months' compensation.
