Q: Dear Sir/Madam,
Greetings for the day.
I have given AED 150,000 to a known person (who is dealing with flat lease), on his emergency situation.
He said he will pay the amount in 3 months. As a security, I took the whole amount in cheque. Apart from that, he had given 3 cheques total for AED 36000 for 3 months.
After a month he left the country and didn't come back for 6 months.
Now, its been 8 months without giving me any amount and now he is here in Dubai. So, I contacted him for the money, and he told me "I don't have money, do whatever you want".
So, I thought of going in a legal way, where I deposited all the cheques of AED 186,000 and it got bounced today.
Please guide me through the legal process, and what is the chance of getting my money back?
Now, I am seriously in a very bad situation. I am about to lose my future in the UAE because of this issue.
Please help me out.

Q: Hi madam,
If a lot of cheques equal to AED 300,000 have been bounced and cases are filed and a travel ban imposed, what will be the punishments or consequences to be faced if caught?
I can't afford to pay back even 1,000 Dhs. Will I have to pay the full amount?
Please advise.

Fraud of a company on the final settlement and credit card of an employee

Q: Respected Sir / Madam,
On Mar 2014, my manager was in the process of transferring my visa to the main company.
On his personal guarantee and assurance, he asked me to sign the receipt of AED 34,894/- towards my full and final settlement for the period I worked from August 2007 to March 2014.
Nevertheless, he never made any payment and just assured that he'll pay the same later, saying that the company used my dues for company urgent expenses.
Also between April 2014 to December 2014, and on many occasions, he requested on his personal guarantee and assurance to use my credit card for company official payments. The amount outstanding is AED 13,337/-.
When I started to follow up on my dues, he simply kept dragging and assuring the payment. I begged him many times to clear my dues but he never made any attempt to pay my dues.
He conned, lied and cheated me with my hard earned money, along with the employer.
The company is closed now and we both are working in different companies.
Please advise regarding the legal options to get my dues from him.

Settlement agreement for paying the amount of a bounced cheque

Q: I have a bounced cheque of AED 75,000. It is under the name of a saloon and the owner is asking me to give her time to pay.
She is telling me that she will pay me monthly starting this end of January, and she will pay AED 100,000 instead.
Is it possible to do an agreement with this? If ever, is this valid in court?

The question is, will the travel ban be removed or will it still be in place?

Q: Hi,
Actually, my old company has given a post-dated cheque for my final settlement. After that, the company owner ran from the UAE.
My cheque bounced, I didn't give any complaint. Now I got information that the company is going to be taken over by another person.
Is there any chance to get that money?
Is there any validity for the bounced cheque?

Asking not to file a civil case and wait for about a month upon cheque bounce

Q: Hi Mr. Ibrahim,
If you have time, I need your opinion on my question.
I decide to move a case I need to do it with someone who knows the local law. I have a bounced cheque from a financial institution in the UAE in the amount of 550,000 AED.
The CEO who gave me the cheque closed the account after issuing the cheque showing proof that his intention was not to pay. When I deposited the cheque, he requested a 2 weeks period to pay me 20% of the amount and begged to wait and not to file a case as he will pay the rest by mid-January.
I have 2 questions:
1- I know that there are changes to the law effective 2nd January, would these changes affect the fact that the cheque bounced in December?
2- Is partial payment a way to block the case and take it to loops for years?

My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
