Unlawful deductions from the salary upon resignation

I submitted my resignation on 10 March. The problem is that they want to deduct food and accommodation allowances because I don't want to continue.

They told me this money was transferred by mistake. Now they prepared a settlement with the deducted money (700 x 14 months).

Tell me what to do.

Dear Sir,

Thank you for getting in touch with me on this.

Please note that you are entitled to your allowances as per the Labour Contract with the Ministry of Labour. The company cannot unilaterally deduct such sums under the garb of a "mistake".

Hence I would advise you to go through your contract and check the total salary (basic + allowance) and ensure that it is the sum deposited in your account monthly.

In case the company deducts the sum from your settlement letter, then you can raise a labour complaint with the court to claim such deductions.

I trust you will find the above helpful.

Regards,

Hari Wadhwana
