Execution of a labour judgement to get salaries and settlement

I have a labour case with my company for non-payment of settlement and pending salaries.

The judgement came in my favour. What is the next step after the judgement of a labour case?

Dear Questioner,

You have not mentioned which court you are awarded a favourable judgement from.

I assume it is from the first court. Once the judgement is pronounced, you should apply after 30 days for a stamp on the judgement which will cost you AED 70.

After stamping the judgement, you may file an execution memo to the court. If the judgement was in the absence of the other party, the same has to be published which will cost you approx AED 250.

If not, the court will send a notification to the other party with regard to the execution giving them 15 days time either to pay and settle the judgement amount or to file an objection.

The other party may file an objection against the execution and if the stated reasons are valid the judge will accept the objection otherwise the same will be rejected.

If the other party fails to comply with the above order, you may request the court to attach the assets of the other party.

In your case, you may request the court to attach the company and its assets or also even request the arrest of the company manager.

Hope the above explanation could throw some light to the procedures of execution. Please feel free to contact me if you need any further details.

Thank you.
