الأحقية في التعويض عن الفصل التعسفي

مرحبًا يا سيدي،

مساء الخير.

من فضلك، أنا بحاجة إلى نصيحتك. لقد عملت في شركة تشييد وبناء لمدة 15 عامًا كمهندس مدني. انتهت تأشيرتي الأخيرة في 25.02.2019 وكنت قد أجريت الفحص الطبي في 17.02.2019.

لكن تلقيت إخطارًا بإنهاء الخدمة في 20.03.2019 وإعطائي وقتًا حتى 17.04.2019. لكن في الوقت نفسه، جددت شركتي تأشيرتي وبهذا أصبحت سارية حتى عام 2021.

هل أنا مؤهل للحصول على راتب حتى 17.04.2019 فقط (شهر واحد) أم يتعين على الشركة دفع 3 أشهر لإنهاء عقدي مباشرة بعد التجديد؟

أصدرت تأشيرتي في 17.02.2019 وتلقيت إخطار الإنهاء بتاريخ 20.03.2019.

Thank you for getting in touch with me on this.

Please advise whether your contract is limited or unlimited in nature. I am assuming it is unlimited for the advice.

You are eligible to claim three months of salary as compensation towards arbitrary dismissal if the termination is without any reasons related to work (for eg redundancy, restructuring...etc).

Please note that you are entitled to compensation for up to three months and not three months, the period of compensation is at the discretion of the judge.

In summary, you will be entitled to claim your notice period salary, gratuity, leave salary (if any) and compensation towards arbitrary dismissal.

Yes, my contract is unlimited & the termination is without any reason.

I can forward all the required documents i.e. the signed contract, termination notice & recently renewed visa copy...etc.
