Questions & Answers
What are the next steps after the court’s final decision, and how can I pay in installments?
Hello,
I received the final decision from the court regarding the cheque execution filed. What is the next step?
How can I pay on an installment basis? How can I request the excess amount regarding the 6% of the loan amount filed, since the final verdict amount was reduced?
I also made a deposit to the court of 10,000 AED. How can I request it back?
I appreciate your advice, and many thanks.
Hello,
Regarding your court-issued final decision for the cheque bounce execution case:
1. To pay the amount by installments, you need to formally request the court or the enforcement authority handling your case. This can usually be done by submitting a written application explaining your financial situation and proposed payment plan. The court may approve installments if it finds your request reasonable.
2. To claim the excess amount related to 6% of the loan amount that was included in the original claim but reduced in the final verdict, you should file a refund request to the court that issued the judgment, attaching proof of the reduced amount and payment receipts or proof of the initial deposit.
3. For the AED 10,000 deposit made to the court, you can submit a refund application to the court treasury or the relevant judicial department. This request should include the case details, receipt of deposit, and any related judgment documents showing amounts owed or refunded.
If you need help drafting these applications or navigating the refund and installment processes, I am available to assist.
Dear Sir,
With regard to the final court decision concerning the execution of the cheque:
On payment by installments:
You may submit a formal request to the Execution Court asking for payment in installments. The court has discretion to accept or reject this request depending on your financial circumstances and the supporting documents you provide.
On claiming excess amounts over the 6% loan interest cap:
If the judgment included interest exceeding the statutory limit of 6%, you may apply for a correction or reduction of the execution amount by filing a petition before the Execution Judge, attaching calculations and supporting documents.
On refunding the AED 10,000 deposit:
You may file a request with the Execution Court for the release of the deposited amount, provided that it is no longer required as security and all conditions have been satisfied. The court will issue an order for a refund after verifying the case file.

After a final decision is issued to enforce a check, you must submit a request to the enforcement court to request payment in installments. This decision is at the discretion of the enforcement judge based on your financial situation and ability to repay. To recover the AED 10,000 deposit, you must submit a separate request to the court.

Based on the final court decision, here are the usual next steps:
Payment by Installments
• Submit a petition in the same execution file requesting payment by installments (طلب تقسيط).
• Attach the final judgment, Emirates ID/passport copy, proof of income, and a proposed payment plan.
• The execution judge will review your request and may set a first lump-sum payment.
Refund of Excess Execution Fees
• Execution fees are 6 % of the claim amount, capped at AED 30,000.
• Since the verdict amount was reduced, you can request a refund of any excess fee by filing a petition for refund (طلب رد الرسوم الزائدة) and providing the judgment and original fee receipt.
Return of AED 10,000 Deposit
• File a petition for release of the security deposit (طلب استرداد مبلغ التأمين) with the court receipt and ID.
• The court will transfer the amount back to your bank account or issue a cheque once approved.
All petitions can be submitted through the Dubai Courts e-Services or directly to the Execution Department.
Please let us know if you would like us to prepare and file these applications on your behalf.

In the UAE, dealing with court decisions and financial obligations can be complex, but here are some general steps you can take based on your situation:
1. Paying on an Installment Basis:
- If you wish to pay the amount due in installments, you will need to file an application with the court requesting permission to do so. This is typically done through a petition or a request for installment payments. You may need to provide evidence of your financial situation to justify your request.
- It is advisable to consult with a lawyer who can help you draft the application and represent you in court. The lawyer can also negotiate with the creditor on your behalf to agree on a feasible installment plan.
2. Requesting Excess Amount:
- If the final verdict amount was reduced and you believe you have paid an excess amount, you can file a request with the court to reclaim the excess. This is usually done through a formal application or petition.
- Again, having a lawyer can be beneficial as they can ensure that your application is correctly drafted and submitted, and they can represent you in any necessary proceedings.
3. Requesting Deposit Refund:
- To request the refund of the AED 10,000 deposit you made to the court, you will need to file an application for the release of the deposit. This is typically done once the court case is concluded and any obligations are settled.
- You should provide any necessary documentation that proves the deposit was made and that the case has been resolved.
4. General Advice:
- It is highly recommended to seek legal advice from a lawyer who is experienced in UAE law. They can provide personalized guidance based on the specifics of your case and ensure that all procedures are correctly followed.
- Keep copies of all court documents, payment receipts, and correspondence related to your case, as these will be important for any applications or requests you make.

Your situation relates to a final judgment in a cheque execution case. We have previously represented clients in an almost identical position, where, after the verdict was issued, the debtor wished to settle in installments and recover excess payments made to the court.
In that matter, we successfully applied for court-approved installment payments and obtained a refund of the deposit after proper reconciliation of the execution file.
There are several possible steps. To request payment by installments, you must formally file an application before the execution judge, supported by proof of your financial capacity and commitment.
The court may approve installment arrangements if it is convinced that this will not prejudice the creditor.
Regarding the excess 6% claimed, once the final judgment reduces the liability, you can apply for an adjustment of the execution file and request a refund of the difference.
As for the AED 10,000 deposit, it can be reclaimed through a petition to the court treasury once the file is reconciled and no further obligations remain.
The exact process depends on the execution court handling your case and the supporting evidence you provide.
We can prepare the required applications and follow up to ensure smooth approval and refund.
Our consultants are available in Arabic, English, Russian, Hindi, and Chinese to guide you step by step.

Dear User,
You can submit an official request to the Execution Judge at the court that handled the case.
Approval for installment payments is not guaranteed 100%; it depends on the court’s discretion and the creditor’s approval.
Since the final verdict reduced the claimed amount, you can request a refund of the difference between the claimed amount and the amount awarded by the court.
This is done by filing a request with the court, which will review the difference, and if an excess amount is confirmed, it will be refunded.
As for the deposited amount, if it was held as a guarantee during the case, it can be refunded once the case is closed, your dues are settled, and it was not used to settle the debt or claimed by the other party.
