Can I renew my visa despite having a pending police case and a travel ban?

I currently have a pending police case and a travel ban. My visa is about to expire and is due for renewal.

I checked with the police, and the case is still under review because the complainant has not submitted the required medical report, despite being asked for it for almost a year.

Is there a chance that my visa renewal will be rejected? Also, can I request the dismissal of the case since the complainant has failed to provide the necessary report?

Yes, there is a possibility that your visa renewal will be refused due to a pending police case, even if the delay is due to the complainant.

You may be able to request that the case be dropped if the complainant does not submit the required medical report within a reasonable period of time or based on a decision from the relevant judicial authority.

Dear User,

If the case is still at the police level (and has not been referred to the Public Prosecution or court), then in most cases, visa renewal is not automatically rejected.

However, you may face delays or a temporary hold on the application until the case is resolved or the travel ban is lifted.

You can submit an official request to have the case dismissed or closed, especially in the following situations:

- A long period has passed without the required documents being submitted (e.g., the medical report).

- The complainant has failed to respond despite being officially asked.

- There is insufficient evidence to support the claim.

Greetings,

Your visa renewal may face complications if there is an active police case or travel ban, even if the complainant has delayed submitting the required documents.

In some situations, it is possible to request dismissal of the case due to a lack of evidence or delay by the complainant, but this requires a proper legal application through the relevant authorities.

To assess your exact position and take the right legal steps, we recommend booking a consultation or appointing Future Vision for Advocacy and Legal Consultancy to handle the matter on your behalf.

Yes, your visa renewal may be rejected if the travel ban is active in the immigration system. Since the complainant has failed to provide the medical report for almost a year, you can (through your lawyer) apply to the Public Prosecution for dismissal of the case due to lack of evidence.

If the case is dismissed, the travel ban will be lifted, allowing your visa renewal to proceed.

In your situation, two separate aspects need to be considered: the visa renewal and the pending police case.

On the visa renewal, immigration authorities generally check if there are any pending travel bans or serious police restrictions.

Since you already have a travel ban, your renewal may face complications, but in practice, many times the renewal is still processed unless there is a final judgment or a strict directive from the authorities.

It depends on how the police have coded the case in their system, so it’s not an automatic rejection, but a risk does exist.

On the police case, since the complainant has failed to submit the required medical report for such a long period, you have a strong ground to request the case be dismissed for lack of evidence or for being abandoned.

This can be done formally through your lawyer by filing a request with the Public Prosecution to either close the file or dismiss the matter due to non-submission of evidence.

It would be best that we step in formally to prepare and submit the dismissal request, and at the same time coordinate with immigration to safeguard your visa renewal.

I suggest we discuss this in detail, review your police file and immigration status, and then take the proper legal steps.

Please reach out to me directly on WhatsApp or by phone at [------------] so I can assist you further.

Dear questioner,

Yes, you can and absolutely should request the dismissal of the case. The police and public prosecution do not keep cases open indefinitely, and the complainant's failure to provide a required medical report for almost a year is strong evidence that they are not serious about pursuing the case, which risks your visa renewal and travel purposes.

If you need our assistance in closing the case, kindly share your WhatsApp number.

Thank you for contacting us via Legal Advice Middle East!

Your situation involves two separate but connected issues: the pending police case with a travel ban, and the upcoming visa renewal.

We recently advised a client in a very similar position, where the complainant failed to submit the required evidence for months. The case stayed technically “open,” which created obstacles with immigration procedures, including visa renewal.

There are two possible scenarios. In some cases, the immigration system allows visa renewal if there is no active court conviction, even with a pending police file. In other cases, the renewal is blocked automatically because of the travel ban linked to the police case.

The hidden risk is that the delay caused by the complainant does not automatically close the file, so the system continues to treat it as active until the police or prosecution formally dismiss it.

As for dismissal, yes, you can file a formal request with the police or prosecution to close the case due to non-cooperation or failure by the complainant to provide the required medical report.

In a case we handled recently, our petition emphasized that the complainant’s inaction for over a year prejudiced the accused, and the prosecution agreed to dismiss the file. This cleared the way for visa renewal and removal of the travel ban.

The most strategic step is to file an application through legal representation, asking the prosecution to either dismiss the case or set a strict deadline for the complainant to submit the report.

Our office can draft and submit this petition, follow up with the relevant authority, and ensure your visa renewal is not jeopardized unnecessarily.

To advise you precisely, we would need to review your police case details, the travel ban status, and your visa category.

Our multilingual consultants are available in Arabic, English, Russian, Hindi, and Chinese to assist you.

First: Residence Renewal with a Travel Ban

Correct: A travel ban by itself does not prevent the renewal of a residence visa. A travel ban only restricts exit/entry.

What may affect renewal is the existence of an administrative block (ICP/GDRFA system hold) linked to the case. If there is no such block, the residence visa can be renewed normally.

If an administrative block appears during renewal, it can be resolved by addressing the authority that placed it (police/prosecution) and requesting its removal for renewal purposes only, without affecting the ongoing investigation.

Second: Requesting Closure/Dismissal of the Complaint for Lack of Medical Report

Since the complainant has failed to provide the mandatory medical report for nearly a year despite repeated requests, this forms a valid ground to:

- Submit a request to the police to close or dismiss the complaint for lack of essential evidence.

- File a petition with the Public Prosecution requesting dismissal/archiving of the case due to the complainant’s lack of seriousness and delay in presenting evidence.

Once a dismissal order is issued, you can immediately request the lifting of the travel ban. If dismissal is denied, you may challenge it before a higher prosecutor or criminal judge to lift or limit the travel ban.

Practical Recommendations

Obtain an official case status letter from the police confirming that the complaint is pending due to the complainant’s failure to submit the medical report.

File a formal memorandum for dismissal, highlighting the long delay and previous police notices to the complainant.

Proceed with residence renewal through your employer; if an administrative block exists, we will petition the prosecution to remove it for renewal purposes.

If needed, request a temporary lifting or suspension of the travel ban (e.g., for medical or urgent reasons) while awaiting the final decision on the complaint.

What We Require to Represent You

Complaint/case number, copy of passport and Emirates ID, evidence of police communications with the complainant about the medical report, and the employer’s letter regarding residence renewal.

We are ready to legally represent you to pursue dismissal of the complaint, request lifting/suspension of the travel ban, and resolve any administrative system holds to ensure smooth renewal of your residence visa.

Dear Client,

Thank you for your enquiry!

Regarding your visa renewal while having a pending police case and travel ban:

1. Since your case is still under police review and the complainant has not submitted the required medical report for nearly a year, there is a possibility of requesting dismissal of the case due to lack of evidence. You can make a formal application to the competent authorities or public prosecution to consider case dismissal for the absence of necessary documents.

2. Visa renewal decisions with ongoing police cases and travel bans depend on the case status and directives from immigration authorities. If a travel ban is enforced against you, your visa renewal will likely be rejected until the ban is lifted or the case is closed.

3. However, it is possible to submit a court or prosecution request to lift or temporarily suspend the travel ban to facilitate visa renewal under exceptional circumstances.

We recommend consulting quickly with a legal advisor to file a dismissal request and liaise with immigration to explore options for your visa renewal. Early intervention can help avoid visa expiry penalties or illegal overstay.

Please let me know if you would like assistance in handling these procedures.

Best regards,

Abdul Wahied
