Overcrowded flat eviction and claim of the security deposit

Hi.

I am staying at Jumeirah Lake Towers, and it is one of the overcrowded flats. After the rule came from DMCC, we cannot stay in an overcrowded flat.

However, my landlord is not ready to refund my deposit now, and every month comes and takes the advance rent from us. We are in a trap and not able to leave the flat.

Please guide me how can I highlight it to the DMCC, and what would be the impact on us in that case? He is asking us to leave the deposit and leave.

Although I have given him notice of 20 days he is not to consider that, and asking to give one month notice starting from the 1st of every month

Dear Questioner,

Please note that the concept of sharing is not legally accepted in the UAE. Even if it is widely practised and openly spoken about.

Before the law, the lead tenant of each unit is the only tenant. In your case, please clarify if you have a contract with the landlord or not?

Who is the lead tenant for the apartment? Is the contract registered with Ejari or not?

Thanks a lot for your response

 No contract has been signed between us. It's just the bed space.

Run by the lead tenant and I think Ejari is in his name only. As he told me, I am giving advance cheques for the flat and I need exactly one month notice period.

In this case, the only person who has the right to object to any of the landlord's practices is the lead tenant.

Also, this contact signed between the lead tenant and the landlord has to be reviewed and compared to the actions to see if it is within the legal frame or not.
