Consequences of resigning during the probation period

Can I resign during the probationary period without the risk of paying any fees to the employer?

The employer said that they will charge me with 3 months.

Dear Sir/ Madam,

Thank you for getting in touch with me on this.

Please note that according to Article 116 of the Federal Law No. 8 of 1980 (UAE Labour Law), if an employee terminates the contract for reasons other than those specified under Article 121, then the employee shall be liable to compensate the employer for an amount equal to 45 days of basic salary.

The employer demanding a salary for three months is not legally valid and you should challenge it.

However, if you are employed in the mainland (i.e. not in free-zones), then you run a risk of having a labour ban levied on you for 6-12 months.

This means you can stay in the country but cannot work elsewhere. This labour ban will allow you to work in free-zones only.

I trust you will find this appropriate.

Regards,

Hari Wadhwana
