Questions & Answers
Which date do I consider when I start counting my probation period?
Please, how do I get to start counting my probation period?
I came to the UAE on the 17th of March and started working on the 21st of March, but I got my Emirates ID on the 14th of May.
So which one would I use for counting?
Hii,
Thank you for your query regarding the start of your probation period under the UAE Labour Law.
Based on the legal framework, the probation period begins from the actual date of commencement of work, not the date of arrival in the UAE or the issuance of the Emirates ID.
Since you began working on 21st March, that date is considered the official start of your probation. The Emirates ID issuance on 14th May does not affect this timeline.
Please note that the maximum probation period allowed by law is six months, which would place the end of your probation around 21st September, assuming no earlier confirmation or changes were made in your employment contract.
It’s also important to consider the legal notice requirements and rights that apply during this period.
For a thorough review and tailored legal advice, I recommend scheduling a formal consultation to go over your employment contract and any specific concerns you may have.
Best regards,
