قراءة للفصل 175 من مجلة المرافعات المدنية والتجارية
جاء بالفصل 175 من م.م.م.ت أنه "يمكن الطعن بالتعقيب في الأحكام النهائية الدرجة وذلك في خصوص الحالات الآتية... أولاً: إذا كان الحكم مبنيا على مخالفة القانون أو خطأ في تطبيقه أو تأويله..." قد توحي هذه الصيغة بأن هذه الحالة هي الحالة العامة للطعن بالتعقيب، أي خرق القانون، وأن الحالات الأخرى لا تعدو أن تكون حالات خاصة تنضوي تحتها. وقد نجد لهذا الطرح سنداً لغوياً هو إمكانية عطف الخاص على العام، وقد نجد له حجة منطقية هي أهمية الحالات الخاصة. للدعوى المدنية ثلاثة أركان هي الأطراف والموضوع والسبب، والملاحظ أن المشرع لم يعرف سبب الطلب الذي أورده بمجلة الالتزامات والعقود ومجلة المرافعات المدنية والتجارية في غير موضع (تراجع على سبيل المثال الفصول 481 و523 من م.ا.ع و 26 و148و226 من م.م.م.ت). وقد ظهر رأيان فقهيان يذهب أولهما إلى أن سبب الدعوى هو أسسها القانونية، في حين يراه آخرهما في عناصرها الواقعية. الطعن بالخطأ البين
لم يجعل المشرع التعقيب درجة ثالثة للتقاضي وذلك لاختصار المنازعات وضمان استقرار الأوضاع، ولذلك فلا يمكن مبدئياً الطعن في القرار الصادر عن محكمة التعقيب. غير أنه استثنى من هذا المبدأ المعمول به في القانون المقارن حالة الخطأ البين، إذ خول في هذه الحالة الطعن في القرار الصادر عن إحدى دوائر محكمة التعقيب. فقد قضى الفصل 192 من م.م.م.ت أن الدوائر المجتمعة تنظر أيضاً عند وجود خطأ بين في قرار صادر عن إحدى الدوائر. وقد حدد المشرع ثلاث حالات لهذا الخطأ، عند وقوع إحداها جاز الطعن بالخطأ البين طلباً لتصحيحه.
