تشريعات دولة الإمارات بشأن مواجهة غسل الأموال ومكافحة تمويل الإرهاب

مع صدور قرار مجلس الوزراء رقم (58) لسنة (2020) في شان تنظيم إجراءات المستفيد الحقيقي، ومدى مساهمته في الحد من جريمة غسيل الأموال و تمويل الإرهاب، لا بد بدايةً من معرفة مفهوم غسيل الأموال و تمويل الإرهاب. تُعرَّف عملية غسل الأموال بأنها كل معاملة مالية أو مصرفية تهدف إلى إخفاء أو تغيير هوية الأموال المتحصلة بطرق غير قانونية، وذلك بتمريرها عبر النظام المالي والمصرفي لكي تظهر على أنها نابعة من مصادر شرعية، و من ثَمَّ إعادة ضخها واستثمارها بشكل قانوني مغاير لحقيقتها.

الطعن بالخطأ البين

لم يجعل المشرع التعقيب درجة ثالثة للتقاضي وذلك لاختصار المنازعات وضمان استقرار الأوضاع، ولذلك فلا يمكن مبدئياً الطعن في القرار الصادر عن محكمة التعقيب. غير أنه استثنى من هذا المبدأ المعمول به في القانون المقارن حالة الخطأ البين، إذ خول في هذه الحالة الطعن في القرار الصادر عن إحدى دوائر محكمة التعقيب. فقد قضى الفصل 192 من م.م.م.ت أن الدوائر المجتمعة تنظر أيضاً عند وجود خطأ بين في قرار صادر عن إحدى الدوائر. وقد حدد المشرع ثلاث حالات لهذا الخطأ، عند وقوع إحداها جاز الطعن بالخطأ البين طلباً لتصحيحه.

تعديلات قانون الشهر العقاري المقرر دخولها حيز التطبيق

أثارت التعديلات التي تم إقرارها في قانون الشهر العقاري والمتعلقة بتسجيل العقارات بصفة رسمية جدلاً واسعاً في مصر، بعد أن كان العرف السائد يعترف بصحة التوقيع دون التسجيل الرسمي في الشهر العقاري. وهذا ما أدى لفرض ضريبة جديدة تبلغ 2.5% من قيمة العقار ودفع مجلس النواب للتدخل وتأجيل تطبيق هذه التعديلات.
