نشأت فكرة المحاماة بدايةً من بريطانيا عندما كانت دولة استعمارية تجوب العالم، وظهرت فيها طبقات اجتماعية غنية ومنها طبقة النبلاء الذين أخذوا على عاتقهم مهمة تحقيق العدالة والدفاع عن كل مظلوم في العالم. وبعد ذلك انتشرت فكرة المحاماة في جميع دول العالم، وأول ظهورها في الدول العربية كان في مصر حيث صدرت فيها أول لائحة لتنظيم مهنة المحاماة عام 1884 م وأول قانون ينظم مهنة المحاماة كان القانون رقم 26 لسنة 1912 م، وبعد ذلك في تونس عام 1920 م، ثم في السودان عام 1935 م، وبعدها في الأردن عام 1950 م.
