مهنة المحاماة في الأردن من حيث نشأتها والتشريعات التي تنظمها

نشأت فكرة المحاماة بدايةً من بريطانيا عندما كانت دولة استعمارية تجوب العالم، وظهرت فيها طبقات اجتماعية غنية ومنها طبقة النبلاء الذين أخذوا على عاتقهم مهمة تحقيق العدالة والدفاع عن كل مظلوم في العالم. وبعد ذلك انتشرت فكرة المحاماة في جميع دول العالم، وأول ظهورها في الدول العربية كان في مصر حيث صدرت فيها أول لائحة لتنظيم مهنة المحاماة عام 1884 م وأول قانون ينظم مهنة المحاماة كان القانون رقم 26 لسنة 1912 م، وبعد ذلك في تونس عام 1920 م، ثم في السودان عام 1935 م، وبعدها في الأردن عام 1950 م.

أبرز التعديلات التي طرأت على قانون أصول المحاكمات المدنية الأردني

من أبرز المؤشرات على تقدم المجتمعات هي التعديلات التي تطرأ على قوانينها لكي تواكب تقدم تلك المجتمعات. فالمشرع يأخذ بعين الاعتبار عند وضع القواعد القانونية بأن ما يصلح منها في تلك الآونة لتنظيم العلاقات والمعاملات بين الأشخاص، طبيعيين كانوا أم معنويين، ربما يصبح في وقت لاحق غير ذي فائدة لتلك العلاقات. إن ما نشهده في الآونة الأخيرة من تطور تكنولوجي هائل وما يستتبع ذلك من تقدم على كافة الصعد الاجتماعية والاقتصادية والقانونية وغيرها، يفرض على المشرع إجراء تعديلات على القوانين لكي تواكب ذلك التطور.

مع تطور المجتمعات البشرية الأولى، بدأت القواعد القانونية بالظهور لتنظيم حياة البشر في علاقاتهم ومعاملاتهم مع بعضهم الآخر ودرءاً للفوضى التي يمكن أن تنجم عن ترك الباب مشرعاً أمام الجميع لاستيفاء حقهم بأنفسهم. فكانت شرائع حمورابي ملك بابل أولى القوانين الوضعية المدونة في هذا الصدد. لكن تلك الشرائع لم تعد كافية وحدها فيما بعد مع توسع المجتمعات واختلاف حاجات البشر. فكان لا بد من تعديل وتطوير القواعد القانونية وظهور منظرين قانونيين في المجتمعات الحديثة أمثال هيجل وأوستن وجيني وسافيني وغيرهم.

الفاعل الأصلي للجريمة والشريك والمتدخل والمحرض وفقاً للقانون الأردني

يعتقد البعض أن الفاعل الأصلي في جريمة ما يتحمل المسؤولية منفرداً أو الجزء الأكبر منها على الأقل، وينجو باقي أعوانه وشركاؤه أو ينالون عقوبة مخففة. ربما يكون هذا صحيحاً في بعض الحالات المحددة، لكن قانون العقوبات الأردني رقم (16) لسنة 1960 ميَّز ما بين الفاعل الأصلي والشريك والمحرض والمتدخل في الجريمة وأنزل العقوبة نفسها بكل منهم كما لو كان الفاعل الأصلي ذاته، ما خلا بعض الحالات الخاصة المحددة قانوناً. لذا نستعرض وإياكم تعريف القانون لكل من تلك الأفعال الجرمية، ورأي محكمة التمييز الجزائية الأردنية.
