إقرار الأثر المنشئ لترسيم عقد الرهن العقاري

اقتضى الفصل 305 جديد من مجلة الحقوق العينية أن "كل حق عيني لا يتكون إلا بترسيمه بالسجل العقاري..."، وجاء بالفصل 278 منها : "لا يتكون الرهن العقاري إلا بعد ترسيمه...". ومفاد هذا أن الترسيم قد أصبح سنداً لنشأة الرهن العقاري، فلا يوجد هذا الرهن سواء بين أطرافه أو تجاه الغير إلا بإشهار كتبه.
