إثارة الدفع بعدم الاختصاص الدولي للمحاكم التونسية

لقد سبق لنا بيان أن الاختصاص الدولي للمحاكم التونسية ذو طبيعة مزدوجة، فهو إما اختصاص مبدئي أي يمكن أن تشترك فيه المحاكم التونسية والأجنبية، وإما اختصاص استثنائي يقصي جميع المحاكم الأجنبية (يراجع مقالنا طبيعة الاختصاص الدولي للمحاكم التونسية). فإذا كانت المحاكم التونسية غير مختصة اختصاصاً ممكناً أو إقصائياً، فيجب إثارة هذا الدفع قبل الخوض في الأصل طبق الفصل 10 من مجلة القانون الدولي الخاص، وهذا ما يوجب النظر في طبيعة هذه الإثارة وكيفيتها.
