Q: Dear Lawyers, I have a property in Dubai that I rented for 2 years. I gave the tenant a legal notice 1 year in advance to vacate, as I intended to move in. However, the property remained vacant for 2 months, and due to personal issues, I was unable to move in, so I had to lease it to another tenant. Can my previous tenant file a case against me after vacating the property, even though it has been more than 9 months since they left?

What can I do in case of threatening and defaming for a disputed debt?
Q: I am in Abu Dhabi. Someone was disputing about the money he says I owe him. On WhatsApp, I told him if you have a problem, you can complain or report that. Then he started sending me messages saying that I was a liar and a scam. And that he will come to my residential building and tell everyone that I am a liar and scammer, and he will come to my apartment and take the money he claims it’s his. He also made a racial comment about my home country (that this is UAE and not your home country where you can scam people). He also mentioned something bad about my family. I reported this to the police with screenshots of the chat. What else can I do in this case of threatening and defaming?

Q: I bought a car from a dealer and paid all costs in cash. They promised to deliver the car within 2-3 days of receiving the full amount. I paid and forwarded the proof of payment to them on Monday 14 October 2024. I do have a vehicle sales agreement benefiting only the dealer. Today after begging for a follow-up, they informed me that the car will be delivered next week. What is my legal position? Can I cancel the deal and demand a return of my money? Please revert+5

Should I send a new bilingual notice or stick with the original Arabic one to prevent a tenant's appeal?
Q: Hello all, I sent a legal notice to a tenant for non-payment and eviction (nationality: Bangladeshi). The notary sent the notice in Arabic. Now someone has informed me that if I file a case, the tenant may appeal, claiming he didn’t understand the notice because it was in Arabic, which could lead to me losing the case. So I may need to send a new notice in both English and Arabic, despite the tenant subletting the property and giving POA to an Egyptian individual who understands the law well. I went to Tasheel today, and they advised that even if the notice is in Arabic, the tenant will lose the appeal if he doesn`t pay, or even if we lose the appeal, he will still have to pay all due rent. It’s now very confusing whether I should send a new notice in both Arabic and English or proceed with the same notice and file the case.

Q: I am the owner of a tour operator company in Dubai that provides chauffeur services to our clients. I am seeking guidance on the legal requirements for hiring chauffeurs who already possess valid visas, as I do not intend to provide visas myself. Specifically, I would like to know which documents I must prepare to comply with UAE law, aside from a contractual agreement. Is it necessary to obtain a No Objection Certificate (NOC) from the company that issued their current visa? Additionally, should the contract explicitly state that they are third-party contractors with my company? What else should be included in the contractual agreement? One of the driver’s CVs states that he has a partner visa. What law would apply in this scenario? Your expertise on this matter would be greatly appreciated.

Should I raise a case for child custody if my ex-wife is alcoholic and left us alone?
Q: A police complaint was filed for physical assault and alcohol abuse. The wife left home without the child and later was interviewed by social support. The wife was guilty after admitting the truth and gave a written statement to visit a psychiatrist and take therapy. She didn`t adhere to the agreement. Followed by a court case, divorce was granted to the husband based on infidelity, neglect, alcohol abuse, failure in maternal duties, verbal abuse, and misuse of social media under article 7 of federal law 41 of 2022, and the wife was obligated to pay expenses and fees under Article 133 of the Civil Procedures Code. The child has been physically with the husband since October 2023 and the entire expenses and well-being are taken care of by the husband. The ex-wife irregularly visits the child, doesn`t provide personal or financial support, forces the husband to give the child a passport and doesn`t want to raise it with the court, and continues to distress claiming that she has not given custody of the child. Should I raise a case for proof of custody or child custody?
