I ordered a car and paid in full but delivery was delayed. Can I cancel the deal and get a refund?
I bought a car from a dealer and paid all costs in cash. They promised to deliver the car within 2-3 days of receiving the full amount.
I paid and forwarded the proof of payment to them on Monday 14 October 2024. I do have a vehicle sales agreement benefiting only the dealer.
Today after begging for a follow-up, they informed me that the car will be delivered next week.
What is my legal position?
Can I cancel the deal and demand a return of my money?
Please revert
Hello,
Even though the agreement primarily benefits the dealer, it should outline the terms of delivery.
Check for any clauses regarding delivery timelines and consequences of delays. If the dealer promised delivery within 2-3 days and has failed to do so without a valid reason, this constitutes a breach of contract.
Under the UAE Consumer Protection Law, you have the right to receive the goods you paid for in a timely manner. If the dealer fails to meet this obligation, you have grounds to cancel the deal.
Send a legal notice to the dealer, stating that you expect the delivery as promised and that failure to do so may lead you to cancel the deal. Include a deadline for response.
If the dealer does not respond satisfactorily, you can file a complaint with the UAE’s Consumer Protection Department.

Dear Questioner,
Thanks for your inquiry.
In the UAE, when you enter into a sales agreement for a vehicle, the terms of the contract are crucial. Here’s what you can consider regarding your situation:
Sales Agreement: Since you have a vehicle sales agreement, even if it primarily benefits the dealer, it establishes a contractual obligation. If the dealer has failed to deliver the vehicle within the promised timeframe, they may be in breach of contract.
Timeframe for Delivery: The fact that the dealer promised delivery within 2-3 days creates an expectation. If they have not met this timeframe without valid justification, you may have grounds to take action.
Legal Position: You can potentially cancel the deal if the dealer continues to delay the delivery. Under UAE law, if there is a breach of contract, you may have the right to terminate the agreement and demand a refund of your payment.
Written Notice: Consider sending a formal written notice to the dealer stating your intent to cancel the contract due to their failure to deliver the car as agreed. This can serve as a record of your attempts to resolve the issue.
Legal Action: If the dealer refuses to refund your money after you cancel the deal, you may need to pursue legal action. It’s advisable to consult with us as a lawyer who specializes in UAE commercial or consumer law for assistance.
Document all communications with the dealer, as this will support your case if legal action becomes necessary.
Kindly do not hesitate to contact us by phone or email for further guidance.
