Q: Good Morning, I divorced my wife last year in Pakistan and she opened a case in Dubai for child maintenance as I am paying 3000 dirhams for one year daughter. Now I lost my job and they canceled my visa. Soon I have to go back to my country as I didn`t find a job. My questions here: 1. Will I be able to get custody of my daughter as I am returning to my home country? 2. If the judge gives her custody and I will go back to Pakistan, how will I pay for child maintenance and visit my daughter in Dubai? 3. An arbitrary non-compete clause in a labor contract. What to do?
Q: Dear Sir/Madam, I have two questions; one is about the non-compete clause term and another is about predetermined compensation. 1) My contract includes a non-compete clause stating that an employee cannot "in any capacity be engaged, interested or employed in a competitor`s business in the UAE during 12 months after termination of the contract." I don`t work in sales. I am working at a managerial level, I won`t take clients or secrets with me when I leave. Is it valid when I join a competitor in a similar position? Can changing the job title/department avoid this clause? 2) My contract states that if an employee breaches any provisions of the clause, "the employee agrees to pay the damages equivalent to the employee`s monthly salary for each month for the entire period." Does the company need to prove that I caused the damages to the company to file a case? Can they file a case as long as I join any competitor? Q: Dear Sir/Madam, We are from the UK. We made a pre-booking at a hotel in Dubai for eight days. We paid for the entire stay online and received a confirmation text from the hotel for our reservation from March 21st, 2023 at 12:00 am to March 29th, 2023. However, upon our arrival at 2:00 pm today, the staff informed us that rooms are only available at 2:00 pm and requested we pay an additional 360 dirhams for an extra day or wait until the following day. Despite a lengthy conversation, the staff did not provide us with a room, and my wife, one-year-old daughter, and I had to spend the night in the hallway. Q: Hi, My father has a few court cases due to bounced cheques in 2005. He left the UAE before the cheques bounced, which were worth approximately AED 42,000, AED 954,000, and AED 138,000. His brother was managing the business, which caused cash flow problems, resulting in the cheques bouncing in Abu Dhabi. Before this incident, he had lived in the UAE for more than 30 years without any problems. Q: I would like to inquire about getting married in the UAE (regardless of which Emirate). There is one couple planning to get married this March 2023. The groom is a Pakistani Muslim (divorcee) and the bride is Philipina Christian (legally married in the Philippines). The bride is saying that she has not filed the annulment yet in the Philippines, which means that she is still legally married. The bride is saying that there will be no Marriage Contract and the required documents are not yet needed. If they get married in Islamic law, is it legal?
