Will my UAE visa and labor card be canceled after 6-8 months out of country?
Q: Hi, I left the UAE on February 6th. I am on an employment visa in Dubai. The company has closed down, and the owner has gone back to his home country. Will my labor card be canceled automatically once I am outside the country for 6-8 months? Once my Dubai visa expires outside the country, can I re-enter on a new visa? Does the visa or labor card automatically get canceled if an employee is out of the country for 6-8 months and their visa also expires while outside the country? Or do I still need to cancel my labor card? PS: I learned that my labor card expired in 2021. So, will the labor card and visa still get canceled, or does someone have to come and do that? I do not want to file a salary case against the company, nor do I want any legal action. I am considering coming back on a new visa after my old visa gets canceled. كيف يمكنني المطالبة بالراتب غير المدفوع وأيام الإجازات غير المستخدمة التي يحتفظ بها صاحب العمل بعد الاستقالة؟
س: انضممت إلى إحدى الشركات في 22 مارس وقررت الاستقالة في 14 يوليو بنية البقاء في الدولة والتقدم لوظيفة أخرى. بناءً على قانون العمل في الإمارات العربية المتحدة، أعطيت فترة إشعار مدتها شهر واحد. ومع ذلك، طُلب مني العمل لمدة 14 يومًا من 14 يوليو، مما يعني أن آخر يوم لي سيكون 27 يوليو. إنهم غير مستعدين لدفع أجري لبقية فترة الإشعار التي يسعدني العمل خلالها. كما تراكمت لدي 8 أيام من الإجازة السنوية خلال هذه الفترة، حيث لم أستخدمها. هل أحصل على صرف إجازتي السنوية؟ ما هي الخيارات المتاحة لي إذا لم يوافقوا؟2023/07/28

كيف يمكنني تسوية قضية الهروب الخاصة بي ومغادرة البلاد إذا رفض صاحب العمل؟
س: سيدي/سيدتي العزيزة، كنت أعمل مع شركة في أبو ظبي. تم إلغاء تأشيرتي في 26-10-2022 وانتهت فترة السماح الخاصة بي في 26-12-2023. لم أتمكن من مغادرة البلاد بسبب وجود قضية نشطة ضدي. لقد قمت بتسوية الغرامة التي فرضتها المحكمة في 26-01-2023 وتلقيت خطاب إخلاء سبيل. ثم توجهت إلى الهجرة لدفع غرامة تجاوز مدة إقامتي لمغادرة البلاد. لكن ضابط الهجرة نصحني بتسوية قضية الهروب الخاصة بي مع صاحب العمل أولاً ثم الذهاب لدفع أو تخفيض غرامات تجاوز مدة الإقامة والتي لا أعلم عنها شيئًا على الإطلاق. ثم توجهت إلى صاحب العمل لإعطائي شهادة عدم ممانعة أو رفع قضية الهروب ضدي ووافقت على دفع أي رسوم مرتبطة بذلك. لكن صاحب العمل السابق رفض تسوية قضية هروبى وأخبرني أنه لا يمكنهم فعل أي شيء في هذا الأمر ونصحوني بالحصول على تصريح للخروج من البلاد. بناءً على بياني أعلاه، يرجى تقديم المشورة لي بشأن إزالة قضيتي والعودة إلى الإمارات العربية المتحدة للحصول على فرص عمل مستقبلية. مع أطيب التحيات،2023/07/28
