Q: Hello, What are the laws regarding chilled water supply in residential buildings and its effect on air conditioning output? I recently bought an apartment, and despite servicing all the AC units, we cannot get temperatures lower than 25°C in the living area and 23°C in the bedrooms. An independent AC company evaluated this and reported that the chilled water supply to my unit is 20°C, while it should be 7-8°C. What rights do I have in this situation before approaching building management? I am paying for chiller services but not receiving the expected performance. Thank you!

Will I be arrested or face a travel ban for an unpaid debt when returning to the UAE?
Q: Hi, I left the UAE during COVID due to redundancy. I had an apartment in Sharjah, where they were unwilling to cancel my tenancy without penalties. Despite many requests, they refused, and I had no option but to leave the country due to very limited flights. Recently, when I checked the Ministry of Foreign Affairs app, I saw a financial criminal case pending against me, stating I am a most-wanted individual due to failure to pay financial sums. I sent a friend to check on the apartment, and they found that a case had been filed with around 29,000 AED due. I am now planning to visit the UAE for a job hunt. Will I be arrested upon arrival and sent to jail, or will they allow me to enter and impose a travel ban until I pay off the amount? Please advise!+2

Can a new developer cancel my old SPA and take my unit if I refuse to sign the new SPA?
Q: Dear Lawyers, I have a question regarding a new developer taking over a property from an old developer who fled Dubai many years ago. The new developer is trying to get investors to sign a new SPA, which includes additional fees. I have not signed the new SPA yet. The new developer claims: "The Judicial Committee for Incomplete & Cancelled Real Estate Projects in the Emirate of Dubai approved the continuation of the project as planned and instructed the new developer to issue amended SPA contracts to all investors, taking into consideration that non-compliant investor contracts shall be canceled in accordance with the procedures and regulations applied." Accordingly, as per the verdicts, they request all investors to comply with the decisions and verdicts issued within a 15-day notice. I have paid 80% of the total fees, and the project is about 60% complete. Does the new developer have the right to cancel the old SPA and take my unit if I don`t sign the new SPA? Also, can I request the project to be completed?2024/08/17

How can I get a refund from a contractor who failed to complete renovation work?
Q: Dear Lawyers, I hired a contractor for my apartment renovation, and we agreed on the scope of work based on the quotation they provided. I have paid them almost 90% of the total value, but they have not completed the work on time and have not used the materials specified in the quote. They have also significantly delayed the project, and despite multiple follow-ups, they never provided the milestone details for the payment schedule, nor did they adhere to the timelines they committed to. I have payment details, the agreed-upon quotation signed by them, as well as email exchanges and WhatsApp group discussions. However, I don’t have a formal contract or agreement. I made payments whenever they requested, but they have cheated me, resulting in a significant loss of time and money due to delays. I am seeking legal help to obtain a refund from this company and take necessary action against them.

As a partner who loaned money to the company, should I sue the company or my partner?
Q: Dear Lawyers, I am a 50% partner in a company. I had given a 2M AED loan to the company about 10 years ago. There are expert reports and bank records to prove the loan. The company does not have any bank balances or assets. Should I start a lawsuit against the company and demand 2M AED, or should I start a lawsuit against the other 50% partner and demand 1M AED? One benefit of suing the company is that I can obtain an acknowledgment of debt, and later in an execution case, I can issue a certificate of solvency to have the other partner arrested. However, suing the other 50% partner directly would include their name in the executive writ. Please guide me! (I believe all necessary legal information is provided here. Negotiate asset split and spousal support: direct talks, mediator, or lawyer negotiations?
Q: Hello, I am currently getting divorced from my wife in Abu Dhabi. We are Americans, got married in the US 6 years ago, and are both non-Muslims. We are officially divorced and we wrapped up custody proceedings for our 19-month-old daughter last week and it was decided for 50/50, joint custody. I believe the next stage is for asset split and spousal support. Is that best handled with one-on-one talks with my ex-wife, or the use of a moderator, or have lawyer-to-lawyer negotiations? Also, can spousal support be paid from the former wife to the former husband? In the US this is very possible. I am very concerned about this as my ex-wife makes considerably more than I do (we moved to Abu Dhabi so she could take a lucrative position). Thank you!
