How can I get a refund from a contractor who failed to complete renovation work?
Dear Lawyers,
I hired a contractor for my apartment renovation, and we agreed on the scope of work based on the quotation they provided. I have paid them almost 90% of the total value, but they have not completed the work on time and have not used the materials specified in the quote.
They have also significantly delayed the project, and despite multiple follow-ups, they never provided the milestone details for the payment schedule, nor did they adhere to the timelines they committed to.
I have payment details, the agreed-upon quotation signed by them, as well as email exchanges and WhatsApp group discussions. However, I don’t have a formal contract or agreement.
I made payments whenever they requested, but they have cheated me, resulting in a significant loss of time and money due to delays.
I am seeking legal help to obtain a refund from this company and take necessary action against them.
Disputes with contractors can be challenging, especially without a formal contract.
However, by gathering evidence, attempting resolution through communication, consulting legal professionals, considering complaints against their business practices, and preparing for potential legal action, you can take steps toward recovering your losses.
Hello, dear questioner,
If one of the parties breaches the commitment, the other party has the right to cancel it, request recovery, and request compensation for any damage suffered, whether material or moral.
It is not a requirement to have an agreement. If the agreement is through email and WhatsApp messages, this is considered evidence for further discussion.

Dear Questioner,
The law accepts WhatsApp conversations if they are clear and explicit, and does not require a formal contract between the parties.
As a first step, you can send them a legal notice.
If this does not succeed within a week of sending the notice, there is no other option but to file a lawsuit.
Thank you for reaching out and sharing the details of your situation!
I understand how frustrating it must be to deal with a contractor who has not fulfilled their obligations, especially after you've made significant payments based on an agreed scope of work.
Even without a formal contract, the documents and communication you have—such as the signed quotation, payment details, and exchanges through email and WhatsApp—can be crucial evidence in pursuing legal action against the contractor.
The fact that they have failed to deliver on the agreed terms and have used materials different from those quoted can strengthen your case for a refund and possibly compensation for the delays and damages caused.
I can assist you in taking the necessary legal steps to hold the contractor accountable and seek the compensation you deserve.
This may involve negotiating a settlement, filing a complaint with the relevant authorities, or pursuing a claim in court.
