Q: Good morning, My landlord notified me 90 days before my contract’s end of a 15% rent increase, raising it from AED 55,000 to AED 63,250. However, according to the RERA index, the maximum increase should be 5%. I tried to negotiate, but they refused. On October 15, I made an offer and deposit of AED 57,250 (including the RERA-approved increase). The judge accepted it, but the landlord rejected it, claiming their other 1-bedroom units rent for AED 75,000. My contract expired on October 31, 2024. Recently, the landlord emailed saying I’m now staying illegally and will be charged AED 100 per day for not signing a new contract. Last week, I requested a new contract based on the RERA index, but they responded by refusing my offer and deposit, demanding full payment. Q: Dear Lawyers, I am a Dubai resident. I found a property in Dubai to buy through a real estate agent, and the seller agreed on the price I offered. At the time of signing the Sale Contract (Form F) on the DLD website, the system was down, so we signed it manually and gave the deposit check to the agent. The contract stated that the RERA system was down and that when it is back in operation, we should refile Form F digitally within 24 hours. The next day, the agent prepared it, and I signed it, but the seller refused to. He proceeded with the sale of the property to a different buyer and refused to pay the penalty stated in the contract. My questions are: 1. Is this legal? 2. Can he sell it to someone else even though he signed a contract with me? 3. RERA couldn`t block the sale because the contract was done manually and not registered in their system. Do I have legal rights to demand the penalty be paid or for the sale to go through? How can I claim my unpaid salaries if my visa is about to expire and the employer did not pay?
Q: My company has held almost 5 to 6 months of my salary. On 16 May, my contract expired and the company refused to pay me my salary. I asked them for an update as I didn`t travel to work due to lack of funds. There was no reply for 2 days and on the 3rd day, I decided to resign. They accepted my resignation after 2 days. The next day, I completed my handover process and since then I have been following up with them by visiting the company and by email. They have not provided me with the final settlement details yet with all this happening while I am in my grace period. I filed a complaint with the Ministry of Labor. The Ministry representative contacted the finance manager and they told him that the owner was out of the country. Once my grace period is over, who will pay the overstaying charges?
