A former employee is blackmailing me after filing a labor case. What should I do?

Dear Lawyers,

One of my employees is harassing me. I am female; she received her salary and then ran away, filing a case against me in labor court.

I filed for absconding, but the complaint had already been made, and my fee was wasted.

I have WhatsApp messages from her claiming that she will blackmail me. I am a new investor and have no clue what to do. I have no idea about lawyers and what I can do in my favor.

Dear Questioner,

Blackmailing is a serious offense in the UAE. You should report this to the police; providing them with WhatsApp messages as evidence.

The UAE takes cybercrimes and blackmailing very seriously and the police will take appropriate action.

For further assistance, kindly share your WhatsApp number.

Dear Questioner,

It's important to take immediate action when facing harassment, especially in the workplace from an employee. Keep a copy of all WhatsApp messages where your employee is threatening or harassing you.

We can report it to the police, and if she makes further demands, we will need to address the issue. It would be better to seek the assistance of a lawyer to file a case against her for damaging your reputation.

Kindly share your WhatsApp number to discuss this further.

Dear Questioner,

You’re dealing with workplace harassment and potential blackmail. Here’s a concise step-by-step approach:

1. Document Everything:

- Save WhatsApp messages where she threatens or makes inappropriate comments.

- Gather employment records and any incident reports detailing harassment with dates and descriptions.

2. Seek Legal Advice:

Find a labor law attorney experienced in workplace harassment to discuss your situation. Please contact us via phone or email.

3. Responding to the Labor Case:

Work with your attorney to prepare a defense against her claims and consider if a counterclaim is appropriate.

4. Report Harassment:

If applicable, report the harassment to your HR department or file a complaint with local labor boards.

5. Protect Yourself from Blackmail:

Avoid further communication. If threats escalate, consider reporting her to law enforcement.

6. Emotional Support:

Reach out to friends, family, or counselors for emotional support during this stressful time.

7. Stay Informed About Your Rights:

Familiarize yourself with local harassment laws and employee rights.

By following these steps, you can better protect yourself both legally and emotionally.

Dear Questioner,

It is important to handle this matter in a legal and organized manner to protect your rights. Here are some steps you can take:

1. Gather Evidence:

- Collect WhatsApp messages that prove the extortion and harassment. Make sure to save all messages and communications related to the incident, including calls or voice messages if available.

- Also, gather any other documents or evidence that support your case, such as the employment contract, payment receipts, and any relevant legal documents.

2. Address the Labor Case:

Since the employee filed a case for "absconding," you must respond to it legally. There may be a possibility that the case was not filed correctly, or there might be evidence that contradicts her claims.

3. File a Formal Complaint Against the Extortion:

If there are clear messages from the employee proving her attempts to extort you, you can file a complaint with the relevant authorities (such as the police or the public prosecution) against her based on the Anti-Extortion Law or Harassment Law.

4. Stay Calm:

It’s important to remain calm during this stage. The situation seems complicated, but with the proper legal guidance, you can overcome these challenges.

Our scope of work includes the following:

1. Document review and case building – We will evaluate the strength of your case before filing it in court.

2. Preparation of a step-by-step report – We will prepare a report outlining the legal procedures.

3. Clarifying all available legal solutions and fees – We will explain all possible legal options and associated costs.

4- Phone consultation – We will arrange a phone call to explain these solutions.

You can contact us on WhatsApp to proceed further.

Thank you for reaching out and sharing your situation with me!

I understand how difficult and overwhelming this can be, especially as a new investor!

Based on what you've described, the absconding issue along with the blackmail threats over WhatsApp are serious matters that need to be handled carefully.

Firstly, it's important to gather all relevant evidence, including the WhatsApp messages and any other documentation, to strengthen your position.

Since your employee has already filed a labor case, you’ll need to defend yourself against those claims and possibly take additional legal actions regarding the harassment and blackmail.

I recommend you act quickly, as these situations can escalate. I can assist you with both defending the labor case and taking steps to protect your rights regarding the harassment.

We can discuss the legal strategies available to you and take the necessary steps to resolve this effectively.

Feel free to reach out to me directly on WhatsApp or phone, or by email, so we can discuss this further and get started on resolving it.
