Can the court expert extend the timeline of delivering his report?
Q: In my misdemeanor case of 150,000, the case is in the upper court and is with the Ruler`s Court expert. The case went to the Ruler`s Court expert in October 2023, and the expert picked the case in Jan 2024. He said that the report will be ready in Apr 2024. Now there is a 2-month extension. Is there any timeline as to how much time the expert can take? Also, is there a maximum time as to how much time the case can stay in the upper court?

My partner withholds profits and falsely claims ownership. What should I do?
Q: Dear Sir/Madam, I am currently facing a complex situation involving a business partnership gone sour. Two years ago, a friend and I embarked on a bed space business venture without obtaining a trade license. While I covered the full investment, my friend took responsibility for managing the flat. We agreed to split the profits 50-50. However, over the past 8 months, he has been withholding profits and not contributing to utility payments, leaving me to bear the losses. Despite my repeated requests for reimbursement, he consistently delays payment. Recently, he renewed the flat in his name and is claiming ownership. Furthermore, he has replaced me with another partner and refuses to compensate me for my share of the goodwill amount, which amounts to approximately AED 30,000. Additionally, he is spreading false accusations about me to mutual friends, tarnishing my reputation. My question is, do I have any legal rights to claim from him? If so, what would be the appropriate legal procedure to pursue in this case?

Can the school refuse to give the teacher NOC to do private tutoring?
Q: Hello, I am a teacher, working full-time with a school in Abu Dhabi. I have students and I do tutoring, now, tutors must obtain a tutor permit from MOHRE and MOE. However, an NOC is needed from the employer/sponsor. I emailed HR and being unhelpful they refused to give me an NOC knowing very well that I oblige to the conditions and do not tutor my own students or any student from the same school and my work is during my own personal time. What can I do if the landlord evicted me and then rents the apartment for a higher price?
Q: The owner sent me an eviction letter a year ago and told me that he would not rent it again. I’ve asked multiple times if he was going to rent it and increase the price, but he said no. Despite paying for ILOE insurance, the insurance company denies my claim. Is that legal?
Q: Good day, I received a notice of termination two weeks ago. I paid for annual ILOE insurance in Dubai in July 2023, but the insurance company informed me that I am not eligible to claim. Bank rejects my dispute for unauthorized transactions. What next?
Q: Good day, I`m using a credit card with one of the banks in the UAE. I received an SMS stating that my card was added to Apple Pay, followed by a debit transaction of AED 15,000, then two OTPs, and finally seven debit transactions. By the time I blocked the card, a total of eight transactions had occurred, amounting to more than AED 90,000. I immediately called the bank after blocking the card and reported all the fraudulent transactions. I also sent Dispute Forms the same day. The next week, the bank sent me an email rejecting all dispute transactions, stating that they were done in a secure environment with Apple Wallet, etc., and were tokenized transactions. Now they are asking me to pay all outstanding amounts. I did not authorize these transactions, never entered any OTP anywhere, and informed the bank within less than one hour of these fraudulent transactions. How can I resolve this situation? Do I have a chance of winning if I file a civil case?

How to respond to a legal notice from the ex-wife of my brother claiming money from us?
Q: I am from outside the UAE and would like to ask some questions about a possible adversarial proceeding against a legal consultant and a private party in the UAE. A legal counsel from Dubai sent us a legal notice for payment in the amount of 944,586 USD and a 3-day limit of payment for alleged moral damages to her client. They notified me and another party, my brother who’s in the US. The client of this counsel is my brother’s ex-partner. I would like to know the following points based on the tenor of legal notice: 1. Can legal counsels who are not involved in civil litigation give such notices? 2. Are legal counsels permitted to estimate the amount of moral damages without a valid court order? 3. What are the possible sanctions on malicious imputation of a crime and baseless accusation? I have contacted a lawyer in the US but I am yet to be familiarized with UAE law so thank you so much!+3

Do I need to pay my company any compensation if I resign during probation?
Q: I worked for a company and due to the lack of work-life balance affecting my mental and physical health, I submitted my resignation according to the contract I signed. The contract stipulated a two-month notice period during my probation as I joined this company on 05 Dec 2023. I submitted my resignation on March 20 stating my last working day as May 20 But the company released me on April 16. However, for the month of March, I did not receive my salary. Now the company is asking me to sign the visa cancellation letter In this letter there is a clause stating "I certify that I have received all my dues up to date - Employee signature" but I have not received my salary. I also explicitly asked them whether they would deduct any amount for the visas as some people have told me that some companies do such things even when nothing is mentioned in the contract. They replied to that email stating they would provide dues but did not mention any specific date. Please advise me on how to proceed.2024/04/23
