Is it allowed for an employee to abscond and work as a freelancer without our NOC?

Dear Sir/Madam,

My employee was working on a limited-term employment contract. He left the company without notice or resignation and absconded.

For more than a year, he has been working in the UAE as a freelancer (without our NOC), as seen on his social media profiles, including LinkedIn.

Is this allowed? What action can be taken?

Hello,

You have to file an absconding report against him, demand compensation for any payments made to him, and request notice allowance for not completing the legal notice period.

Moreover, the employer can seek redress for breaches of the employment contract and any resulting damages.

Collecting evidence such as the employee's social media activity and relevant documents is crucial to substantiate the case against them.

In summary, departing from a job without proper notice or resignation and engaging in freelance work without the necessary permits is prohibited under UAE labor laws, and employers have the right to take legal recourse against such actions.
