Q: I am seeking advice on an issue involving a shady friend. She has been pressuring me to run social media ads promoting private tutoring services in the UAE, despite not holding the necessary license to offer such classes. She insisted that I use my personal information for these ads and avoid sharing any of her details, claiming it was due to concerns about harassment. However, I suspect her true motive is to avoid legal consequences as she knows this activity is illegal. She wanted me to advertise these services using my social media accounts, and in the event of inquiries, I was to pass on the students to her. My sole evidence is a phone call we had of her directing me to engage in these actions. I need to understand if her requests are legal and if they expose me to any liability, as well as what actions I can take to protect myself given the evidence I have.

Can we terminate a staff member who did not return to work after annual leave?
Q: Hello, We have a staff member who was supposed to return to work on 15 September 2024 from annual leave (they went back to their home country). However, after trying to reach them, they finally told us on 12 September that they have a travel ban due to legal issues that they are being accused of. They said that they have a hearing on 13 Sep and will update us on the matter. However, we have not heard from them since then. We have tried to contact him but nothing. What are our options here? We unfortunately cannot keep waiting for them (as operationally, we needed him back), and due to this being a legal matter (we don`t want him to work for us anymore, it seems serious). Would Article 44 Clause 8 apply here? We haven`t heard from him in over 7 consecutive days, but it also states that it applies if they failed to give a legitimate reason (which technically they have?).

What can I do if the tenant is subletting my property and not paying rent?
Q: The tenant is not paying and subletting nor getting utilities connected in their name. He also changed the door lock after moving in. His security cheques and rental cheques are bouncing & he knows that he will get a. notice so he is prepared for that too. He is part of a tenancy scam where these people pay the first month`s rent as cash then the security deposit post-dated cheque which gets bounced. Can we file a lawsuit directly or do we have to first send a notary notice for vacating and cheque bounce? Can one notice serve both? And can we go to our flat and get details of those staying there? Please advise. They also changed locks and only last month Ejari was signed.+5

Can I claim compensation from the employer if he terminates me with a shorter notice?
Q: I moved from another country for a job almost 6 months ago. Based on the offer letter and employment contract I received and signed, I agreed to a 3-month probation and a 3-month notice period before coming to Dubai. Upon arriving in Dubai, I was then given a MOL contract which I was told was standard 6 months probation. I was told at 3 months that I had passed my probation. I have just come to my 6-month mark (just before my exact 6-month date) and have been told I did not pass my probation and have been given 14 days` notice. Where do I stand? The employer is not negotiating and is stating it is standing by the MOL agreement and not the employment contract. The company has bounced between the 2 agreements in order to suit its own interests.+1

Q: Hi, I’m one of three partners in a family business, where a father holds 50%, and two siblings hold 25% each, with 0% for the service provider. Does the service provider have any claims on the company if something happens to one of the partners? I’m currently the guarantor for a loan, and I have authority over vehicle sales and purchases.
